Ord 2756 12/5/1972 A .1 ORDINANCE NO. ,A 75 AN ORDINANCE EXTENDING THE CITY LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, BY ANNEXING CERTAIN LANDS ADJACENT TO THE TERRITORIAL LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, WHICH LANDS ARE DESCRIBED IN THIS ORDINANCE. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: SECTION 1. That the following tracts of land located in Wichita County and Archer County, Texas, be and the same are hereby ordered to be annexed and to be included within the corporate limits of the city of Wichita Falls, Texas, and the corporate limits be extended so as to include said tracts of land in Wichita County and Archer County, Texas, the same being more particularly described as follows: TRACT Being a tract of land out of and part of the Denton County School lands League 1 , Ab. 58, Denton County School lands, League 2, Ab. 57, and Wm. Meyer Survey A-193 Wichita County, Texas. Being more particularly described as follows : BEGINNING at a point in the north right-of-way line of the Fort Worth and Denver Railroad, said point being in the existing City limits and the intersection point of said north right-of-way line and the west right-of-way line of Alexandria Road as described in Ordinance No. 1854; THENCE north along the west right-of-way line of said Alexandria Road and the existing City limits to a point, said point being 660 feet southeasterly from the centerline of U.S. Highway Nos. 82 and 277 measured at right angles thereto, as described in Ordinance No. 1854; THENCE S66 degrees 34' W along a line parallel to and 660 feet south- easterly from the centerline of said U.S. Highway Nos. 82 and 277 to a point, said point being in the present west right-of-way line of Allen- dale Road, 660 feet southeasterly from the centerline of said U.S. Highway Nos. 82-277 measured at right angles thereto, said point also being in the present City limits as described in Section 1 of Ordinance No. 1910; THENCE south along said City limits line, said line also being the west right-of-way line of Allendale Road to a point, said point being the intersection of said right-of-way and a line 200 feet south of and parallel to the south right-of-way line of Expressway 82 and 277; THENCE easterly along said line to a point, said point being the inter- section of said line 200 feet south of the south right-of-way of Ex- pressway 82-277 and the centerline of Gregg Road extended; THENCE south along the centerline of Gregg Road extended to a point, said point being the intersection of said centerline extended and the existing City limits as described in Tract V, Ordinance No. 2598; THENCE easterly, 200 feet north of and parallel to the north right-of-way line of F.M. Highway 369 to a point, said point being 297 feet N89 degrees 55' W of the original east right-of-way line of Barnett Road and 200 feet north of the north right-of-way line of F.M. Highway No. 369, said point also being in the existing city limits line as described in Section I , Ordinance No. 2169; -1- THENCE NO0 degrees 06' W along said City limits line a distance of 20.4 feet to a point, said point being the southernmost northwest corner of the tract of land described in Section I of Ordinance No, 2169; THENCE N44 degrees 54' E a distance of 98.4 feet to a point, said point being the northernmost northwest corner of the tract of land described in Section I of Ordinance No. 2169; THENCE S89 degrees 55' E a distance of 277.5 feet to a point in the original east right-of-way line of Barnett Road as described in Section I of Ordinance No. 2169, said point also being 290 feet north of the north right-of-way line of F.M. Highway No. 369 and 30 feet east of the west survey line of Block No. 20, Denton County School Lands , League No. 1 ; THENCE north along said original east right-of-way line of Barnett Road 30 feet east of and parallel to the west survey line of said Block 20 toa point, said point being 30 feet south of the north survey line of said Block 20 as described in Section I of Ordinance No. 1852; THENCE west 30 feet south of and parallel to said north survey line of Block 20 to a point, said point being in the west line of Block 17 Denton County School Lands, League No. 1 ; THENCE north along west survey line of said block 17 to a point, said point being the southeast corner of the William Meyer Survey, A193, said point also being in the existing City limit line as described in Section I of Ordinance 2002; THENCE West along south survey line of said William Meyer Survey a distance of 400 feet; THENCE north a distance of 786 feet; THENCE east a distance of 375 feet to the west right-of-way line of Barnett Road; THENCE south along the west right-of-way line of Barnett Road a distance of 750 feet to a point; THENCE east a distance of 25 feet to a point, said point being the inter- section of the east line of the William Meyer survey and the north right- of-way line of the Fort Worth and Denver Railroad, said point also being in the existing City limit line as described in Section I , Ordinance No. 2002; THENCE in a northeasterly direction along said north right-of-way line of the Fort Worth and Denver Railroad to a point; said point being the intersection of the west right-of-way line of Alexandria Road and the north right-of-way line of the Fort Worth and Denver Railroad as described in Ordinance No. 1854, said point also being the place of Beginning, containing 639 acres, more or less. -2- TRACT II Being out of and part of J.R. McDowell Survey A-262, T. Smith A-1140, J. Poitevent Survey A-915, Blocks 8, 9 and 10 German Emigration Survey, being more particularly described as follows ; BEGINNING at a point in the east right-of-way line of U.S. Highway 281 , said point being the intersection of U.S. Expressway 281 East right-of-way and said U.S. Highway 281 East right-of-way, said point also being the existing City limit line as described in Tract III Ordinance No. 2434; THENCE in a southeasterly direction along said U.S. Highway 28i East right-of-way to a point, said point being the intersection of north right-of-way line of a 125 foot easement held by the City of Wichita Falls, Texas, and said U.S. Highway 281 east right-of-way, said point also being 20 feet north of Engineer's survey line for water trans- mission line, Station 400+40 measured at right angles thereto; THENCE S76 degrees 19'30"E along said 125 foot easement north right- of-way line 20 feet north of and parallel to said Engineer's survey line a distance of 7571 .00 feet to a point, said point being 20 feet N 13 degrees 00'50"E from Engineer's survey line Station 324+69; THENCE S76 degrees 59'30"E along said 125 foot easement 20 feet north of and parallel to said Engineer's Survey line a distance of 3001 .58 feet to a point, said point being the intersection of said 125 foot easement north right-of-way and the center line of a county road, said center line being the east survey line of H and T.C. R.R. Co. Survey A-218; THENCE South along said survey line a distance of 128.29 feet to a point , said point being the intersection of said survey line and the south right-of-way line of said 125 foot City easement; THENCE N76 degrees 59'30"W along said 125 foot City easement 105 feet south of and parallel to said Engineer's survey line a distance of 3030.46 feet to a point , said point being S13 degrees 00'50"W of said Engineer' s survey line station 324+69; • THENCE N76 degrees 19'30" W along said 125 foot city easement south right-of-way line 105 feet south of and parallel to said Engineer's survey line a distance of 7628 feet to a point, said point being 105 feet south of Engineer's survey line Station 400+97, said point also being the intersection of said south right-of-way line and the west right-of-way line of said U.S. Highway 281 ; • THENCE in a northwesterly direction along said U.S. Highway 281 west right-of-way line to a point, said point being the intersection of said west right-of-way line of U.S. Highway 281 and the existing City limit line as described in Tract III Ordinance 2434; THENCE east along said existing City limit line to a point, said point being the intersection of said existing City limit line and the east right-of-way line of said U.S. Highway 281 , said point also being the place of beginning, containing 46.65 acres more or less. SECTION 2. In conformity with Section 6 of Article 970a of the Revised Civil Statues of Texas, before these annexation proceedings were instituted, the Board of Aldermen called a public hearing on October 23, 1972 to provide an opportunity for all interested persons to be heard; notice of such hearing was published once in the Wichita Falls Record News not more than twenty (20) days nor less than ten (10) days prior to the public hearing. Such public hearing was held on November 7, 1972, which was not more than twenty days nor less than ten (10) days prior to the institution of these annexation proceedings . -3- • • SECTION 3. In conformity with Section 3-A of the amended Charter of the City of Wichita Falls , Texas , this ordinance is on the 21st day of November, 1972 introduced and the City Clerk is directed to publish said ordinance one (1) time in a newspaper of general circulation publihhed in the City of Wichita Falls, Texas , and seven (7) days thereafter this ordinance may be finally acted upon. SECTION 4. The fact that this is an urbanizing area, and City safety, health and police controls and measures will be needed, creates an emergency, and it is hereby declared that this ordinance is an emergency measure on the grounds of public need for the preservation of the peace, health, and safety of property of the city, and this ordinance shall go into effect immediately upon its passage . This ordinance having been introduced on the 21st day of November, 1972 and having been published in a newspaper of general circulation in the City of Wichita Falls , Te:cas , to wit, the Wichita Falls Record News, one (1) time on the 24th day of Nove.,,ber, 1972 and seven (7) days after such publication having elapsed , this ordinance is finally passed and approved this the 5th day of December, 1972.
