Ord 2763 2/6/1973 ! 1 . 4r ORDINANCE NO. 1753 AN ORDINANCE REGULATING THE PLACING OF SIGNS ON AND OVER PUBLIC PROPERTY AND ON UTILITY POLES, AND AMENDING AND REPEALING PARTS OF SECTION 7-15 AND SECTION 29-77 OF THE CODE OF ORDINANCES. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Subsection (18) of Section 7-15 of the Code of Ordinances is hereby repealed. Any sign which has been hereto- fore lawfully erected under authority of a permit issued pursuant to said subsection (18) shall be allowed to remain in place, and repairs may be made thereto, but no structural alter- ations to such sign shall be made, and such signs shall not be replaced. Further, if the City should hereafter find that such nonconforming sign interferes with the public use of the public right-of-way, the owner of such sign shall, within sixty days after he has been sent written notice by the City to do so, remove such sign from the public right-of-way at his sole expense. SECTION 2. Section 7-15 of the Code of Ordinances is hereby amended by adding a new subsection numbered (15.1) , which shall read as follows : " (15.1) Amend Chapter XXIII, Signs and Outdoor Displays, by adding Section 2301.11, which shall read as follows : 'Section 2301. 11 - No Signs on Public Right-of-Way. No signs of any kind shall be erected or placed on the right- of-way of any street or alley in the city, except for traffic-con- trol signs, signals, and devices placed by the City Traffic Engi- neer under authority of the ordinances of the city, and except for advisory safety and useful directional information signs placed by the city traffic engineer under authority of state law. "" SECTION 3. Section 7-15 of the Code of Ordinances is hereby amended by adding a new subsection numbered (15.2) , which shall read as follows : " (15.2) Amend Chapter XXIII, Signs and Outdoor Displays, by adding Section 2301. 12, which shall read as follows: 'Section 2301. 12 - No Signs on Utility Poles. No signs of any kind shall be attached to any utility pole located in any street or alley right-of-way or utility easement, except by the owner of such pole. '" SECTION 4. Section 7-15 of the Code of Ordinances is hereby amended by adding a new subsection numbered (15.3) , which shall read as follows : " (15.3) Amend Chapter XXIII, Signs and Outdoor Displays, by adding Section 2301. 13, which shall read as follows: ' Section 2301. 13 - Temporary Cloth Signs Across Street. Notwithstanding the other provisions of this chapter, a temporary cloth sign may be permitted to be suspended across a street. When a permit is issued therefor, a cloth sign suspended across the street shall be not less than twenty feet above the street at the lowest point, and shall be suspended by ropes. No metal shall be used in the construction of the sign or in the apparatus supporting same. A cloth sign shall not be allowed to hang more than two weeks, and may be used only for purposes of ad- vertising celebrations, expositions, rodeos, fairs, or activities of churches or other charitable, non-profit, educational or philan- thropic organizations, and shall not be used to advertise a business or commercial matter. '" SECTION 5. Paragraph (b) of Section 29-77 of the Code of Ordi- nances is hereby amended so that it shall read as follows: " (b) No person shall place or maintain nor shall any public authority permit upon any highway any traffic sign or signal bearing - 2 - thereon any commercial advertising."
