Ord 2780 5/1/1973 ORDINANCE NO. 2780 AN ORDINANCE EXTENDING THE CITY LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, BY ANNEXING CERTAIN LANDS ADJACENT TO THE TERRITORIAL LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, WHICH LANDS ARE DESCRIBED IN THIS ORDINANCE. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: SECTION 1. That the following tract of land located in Archer County and Clay County, Texas, be and the same is hereby ordered to be annexed and to be included within the corporate limits of the city of Wichita Falls, Texas, and the corporate limits be extended so as to include said tracts of land in Archer County and Clay County, Texas, the same being more particularly described as follows: A tract of land out of Archer County and Clay County, Texas, extending from the present city limits line of the City of Wichita Falls, Texas, as established by Ord. No. 2756, in a southeasterly direction along the right-of-way of the raw water transmission line and including a portion of those lands conveyed to the City pertaining to the development of Lake Arrowhead; said tract being a strip of land describing the raw water transmission line right-of-way, being more particu- larly described as follows: Being a tract of land out of and part of the H. & T. C. R.R. Co. Survey No. 9-A218, M.J. Coy Survey A-797, A. Graham Survey A-758, B.B.B.&C. R.R. Co. Survey No. 6 A-903, and B.B.B.&C. R.R. Co. Survey No. 7 A-49, being more particularly described as follows: BEGINNING at a point on the centerline of a County road, said County road being along the west survey line of H. & T. C. R.R. Co. , Survey A-218, said point being 107.76 feet north of the southeast corner of the existing city limits line as described in Tract II Ordinance No. 2756, said point being 306.4 feet north of the southeast corner of the A. Jentsch lands, said point being on the centerline of the raw water transmission line from Lake Arrowhead; THENCE with said strip of land, which extends 20.0 feet on the northerly side, and 105.0 feet on the southerly side, of the transmission centerline, along the centerline of said transmission line as follows: South 76° 59' 30" East across the Carter McGregor, Jr. lands and across the H. & T. C. R. R. Co. Survey No. 9, A-218, the M. J. Coy Survey, A-797, the A. Graham Survey, A-758 and the Archer County-Clay County line in all a distance of 8,988.7 feet to a point of curvature in the said A. Graham Survey; THENCE along a 2.000 degree curve to the right, at 619.36 feet pass the East line of the said McGregor lands and the West line of the Casey & Rodgers lands being the West line of the B.B.B. & C. R.R. Co. Survey No. 6, A-903 and being 4245.0 feet North of the Southeast corner of the said A. Graham Survey, in all a distance of 1194.17 feet to a point of tangency in the said Casey & Rodgers lands; THENCE South 56° 06' 30" East 5935.93 feet to a point of curvature; THENCE along a 2.000 degree curve to the right 275.83 feet to a point of tangency; THENCE South 47° 35' 30" East, at 114.8 feet pass the East line of the B.B.B. & C. R.R. Co. Survey No. 6, A-903 and the West line of the B.B.B. & C. R.R. Co. Survey No. 7, A-49, and being 147.5 feet North of the Southwest corner of said Survey No. 7, in all a distance of 334.0 feet to a point in a fence line for the South line of the Casey & Rodgers lands and the North line of the C. J. Bohner et al lands and being 161.3 feet East of the Southwest corner of said Survey No. 7 for the ending point of the strip of land containing 48.00 acres, more or less. • SECTION 2. In conformity with Section 6 of Article 970a of the Revised Civil Statutes of Texas, before these annexation proceedings were instituted, the Board of Aldermen called a public hearing on March 6, 1973 to provide an opportunity for all interested persons to be heard; notice of such hearing was published once in the Wichita Falls Record News not more than twenty (20) days nor less than ten (10) days prior to the public hearing. Such public hearing was held on March 20, 1973, which was not more than twenty (20) days nor less than ten (10) days prior to the institution of these annexation proceedings. SECTION 3. In conformity with Section 3-A of the amended Charter of the City of Wichita Falls, Texas, this ordinance is on the 9th day of April, 1973 introduced and the City Clerk is directed to publish said ordinance one (1) time in a newspaper of general circulation published in the City of Wichita Falls, Texas, and seven (7) days thereafter this ordinance may be finally acted upon. SECTION 4. The fact that this is an urbanizing area, and City safety, health and police controls and measures will be needed, creates an emergency, and it is hereby declared that this ordinance is an emergency measure on the grounds of public need for the preservation of the peace, health, and safety of property of the city, and this ordinance shall go into effect immediately upon its passage. This ordinance having been introduced on the 9th day of April, 1973 and having been published in a newspaper of general circulation in the City of Wichita Falls, Texas, to wit, the Wichita Falls Record News, one (1) time on the 14th day of April, 1973 and seven (7) days after such publication having elapsed, this ordinance is finally passed and approved this the 1st day of May , 1973. i MAYOR • ATTEST: ! / /i►� «.!
