ORDINANCE CLOSING HEARING AND FINDING CERTAIN
BUILDINGS AND/OR STRUCTURES TO BE DANGEROUS:
COMMANDING PROPERTY OWNERS TO REPAIR, VACATE,
OR DEMOLISH SAID BUILDINGS AND/OR STRUCTURES
WITHIN THIRTY (30) DAYS OF THE DATE OF THIS
ORDINANCE AND DECLARING AN EMERGENCY.
WHEREAS, the Building Inspector of the City of Wichita Falls ,
acting under the provisions of Ordinance No. 2388 enacted by the Board of
Aldermen of the City of Wichita Falls on February 12, 1968, notified in
writing by certified mail the following list of property owners of the
property shown that the buildings or building on the premises had been
classified as a dangerous building and that certain corrections were
needed to be made or the building demolished.

WHEREAS , such property owners above have not complied with the
directive of the Building Inspector within the sixty days allotted in Ordi-
nance No. 2388; and,
WHEREAS, the above listed property owners have been notified by
certified mail by the Building Inspector of the time and date of a Public
Hearing for the above named property owners to appear before the Board of
Aldermen to show cause why such building or structure should not be repaired,
vacated, or demolished in accordance with the Statement of Particulars set
forth in the Building Inspector's notice; and said Public Hearing was had and
held at the time and place fixed therefor, to-wit, on the 1st day of May, 1973,
at 10:00 A.M. , in the Council Chambers in the City of Wichita Falls , Texas ,
and at such Public Hearing, the following protests and objections were made,
to-wit:
Mrs. Aurora G. Luera protested that she cannot afford to makepiDDRKCEBCO t
the necessary improvements to the properties. She plans to move the buildings
on the property at 329 Lake, and demolish the buildings on the property at
3.11 and 331 Lake. She explained that she has been ill for
some time, and has no one to help her at this time. Preston McBee noted
that she recognizes that these structures need to be demolished, and she is
cooperating in this respect. He recommended that she be mH41XA
granted a 90-day extension in which to do this work. He pointed out that
at least one of the properties will be in the Kell right-of-way.

Mrs. Jackie B. Russell 's daughter appeared, stating that her impoteeteduChat
mother is using this house, located at 801 Loop 165, for storage purposes. Mr.
McBee stated that, in his opinion, the house is not repairable and recommended
a 90-day extension. She explained that she would repair the MaNDOWDENkAINMX
structure if granted the extension. The Council granted the extension.
Betty Wheaton appeared regarding the property at 1102 Flood. 31C000200404ANOX
Mr. McBee stated that there are six structures on this lot. He believes they
should be demolished since they have been setting idle for so long. Mrs.
Wheaton explained that her father deeded this property to his)Q
children. She has turned it over to a realtor for disposal. They plan to
demolish these structures. She requested a 90-day extension to enable the
realtor to have more time to dispose of it. voodwgulathedx

and said hearing was continued until all desiring to be heard were given
full and fair opportunity to be heard and the Board of Aldermen of the City
of Wichita Falls having fully considered all proper matters , is of the
opinion that the said Hearing should be closed.
NOW, THEREFORE , BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
Said hearing be, and the same is hereby, closed, and the said
protests and objections, and any and all other protest objections whether
enumerated or not, be and the same are hereby, overruled.
From the evidence presented in the aforementioned Public Hearing
by the property owners appearing and the Building Inspector of the City of
Wichita Falls , the building and/or structure at the location listed above
with the corresponding property owner is found to be a dangerous building
as defined in Ordinance No. 2388 and the property owners listed or any other
person having an interest in said building as shown by the tax records of
the City of Wichita Falls are hereby commanded to repair, vacate, or demolish
the building and/or structure in accordance with the Statement of Particulars
set forth in the Building Inspector's notice. The property owner listed or
any other person having an interest in said building as shown by the tax
records of the City of Wichita Falls is further commanded to repair, vacate,
or demolish in accordance with the Statement of Particulars set forth in the
Building Inspector's notice within thirty (30) days from the date of this
ordinance.
The fact that the repair, vacation , and/or demolition of dangerous
buildings is being delayed pending the taking effect of this ordinance creates
an emergency for the immediate preservation of the public business place,
property, health , safety and general welfare of the public which requires that
this ordinance shall become effective from and after the date of its passage
and is accordingly so ordained.
