ORDINANCE NO. 79V
AN ORDINANCE RELEASING AND ABANDONING ALL RIGHTS TO A FIFTEEN
FOOT STRIP OF RIGHT-OF-WAY ADJACENT TO LOT 12, BLOCK 11,
SECTION B, COLONIAL PARK ADDITION TO THE CITY OF WICHITA FALLS,
TEXAS, AND DECLARING AN EMERGENCY.
WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas
deems it advisable and in the public interest to release and abandon all rights
to a fifteen foot strip of right-of-way adjacent to Lot 12, Block 11, Section B,
of the Colonial Park Addition.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
SECTION 1. All rights granted to the City by that certain instrument
as executed by C. B. Christie, Jr. , which instrument is recorded in Volume 1072,
Page 596 of the Wichita County Deed Records, for right-of-way purposes, insofar
as said rights pertain to parcel IV as hereinafter described in said instrument:
Parcel No. IV
Being a strip of land out of the J. A. Scott Survey No. 8, 15.00 feet adja-
cent to Lot 12, Block 11, Section B, Colonial Park Addition to the City of
Wichita Falls, Texas, being further described by metes and bounds as follows:
Beginning at a point in the north property line of Barbados Street at the
southeast corner of lot 12 as shown on the dedication plat of said addition;
Thence N. 54° -17 ' W. a distance of 154.30 feet to a point for a corner;
said point being the northeast corner of lot 12 as shown on the dedication
plat of said addition;
Thence N. 39° -41 ' E. a distance of 15.00 feet to a point for a corner,
said point being in the south side of lot 10, block 11, as shown on the
dedication plat of said addition;
Thence S. 54° -17 ' E. a distance of 154.30 feet to a corner;
Thence S. 35° -43 ' W. a distance of 15.00 feet to the place of beginning and
containing 2310 square feet more or less .
be and the same are hereby released and abandoned.
SECTION 2. The fact that the development of the property adjacent to
Section B of the said Colonial Park Addition is being delayed pending the taking
effect of this ordinance because of the presence of the above described right-of-
way creates an urgent public necessity, requiring that this ordinance be passed
as an emergency measure, and this ordinance is passed as an emergency measure, and
shall be in force and effect immediately from and after its passage.
