AN ORDINANCE ABANDONING THE CONSTRUCTION OF IMPROVEMENTS
ON PORTIONS OF STREETS AT LOCATIONS OUT OF THE 1973
ASSESSMENT PAVING PROGRAM, DELETING SAME FROM CONTRACT
WITH SABRE ASPHALT COMPANY, WICHITA FALLS, TEXAS; AND
CANCELLING THE ASSESSMENT LIENS LEVIED AGAINST ABUTTING
PROPERTIES.
WHEREAS, by Ordinance 2786, dated April 17, 1973, the Board of
Aldermen of the City of Wichita Falls , Texas, a municipal corporation, deter-
mined the necessity of paving and constructing other improvements on portions
of streets designated as a portion of the 1973 Assessment Paving Program in
Wichita Falls, and a notice of such action, in accordance with Article 1220A
of Revised Civil Statutes of Texas, was filed with the County Clerk and was
recorded in Volume 650, Page 528 of the Deed of Trust Records of Wichita
County ; and,
WHEREAS , by Ordinance 2776, dated March 20, 1973; the Board of
Aldermen of the City of Wichita Falls, Texas, adopted the plans and speci-
fications and authorized for the advertisement for bids ; and,
WHEREAS, there is insufficient support and right-of-way for the
constructing of the entire program as proposed by the bids ; and,
WHEREAS, Sabre Asphalt Company, who has contracted with the City
for the construction of said improvements , has consented to the abandonment
of the Improvements on such portions of streets.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
I.
The improvements on the following portions of street shall be
abandoned, and same shall be deleted from the contract with Sabre Asphalt
Company, Wichita Falls, Texas, and the assessment liens heretofore levied
against properties abutting such portions of streets are hereby cancelled,
to-wit:
ONAWAY TRAIL: From the west property line of
Minnetaska Avenue to the west
property line of Hiawatha Blvd.
north of Onaway Trail.
The City clerk is hereby directed to file a notice of this ordi-
nance with the County Clerk of Wichita County, Texas, for the purpose of re-
leasing the assessment liens against such properties abutting the portions
of streets set out above.

NOTICE OF RELEASE OF ASSESSMENT
THE STATE OF TEXAS
COUNTY OF WICHITA X
WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas
a municipal corporation, has heretofore ordered an assessment against cer-
tain property abutting the list of streets listed below; and,
WHEREAS, notices of said assessment were dated March 20, 1973, and
recorded in Volume 650, Page 528 of the Deed of Trust Records of Wichita
County, Texas, to which reference is here made for all purposes ; and,
WHEREAS, by Ordinance No. 2802 , dated June 5, 1973, the
Board of Aldermen released such assessments against the properties abutting
the following portions of streets, to-wit:
ONAWAY TRAIL: From the west property line of
Minnetaska Avenue to the west
property line of Hiawatha Blvd.
north of Onaway Trail.
NOW, THEREFORE , notice is hereby given that such assessment liens
levied against the properties abutting on the above set out portions of
streets have been cancelled.
