ORDINANCE NO. 2808 AN ORDINANCE EXTENDING THE CITY LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, BY ANNEXING CERTAIN LANDS ADJACENT TO THE SOUTH- EASTERN TERRITORIAL LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, WHICH LANDS ARE DESCRIBED IN THIS ORDINANCE (LAKE ARROWHEAD AND PROPERTY CONTIGUOUS THERETO WHICH IS OWNED BY THE CITY OF WICHITA FALLS, PROPERTY WHICH WAS CONVEYED BY THE CITY OF WICHITA FALLS TO THE STATE OF TEXAS FOR PARK PURPOSES, AND PART OF THE RIGHT OF WAY FOR THE WATER TRANSMISSION LINE). WHEREAS, Lake Arrowhead and the lands contiguous thereto which are owned by the City of Wichita Falls, Texas and the State of Texas are being developed and extensively used by the public for recreational purposes, it is deemed advisable by the Board of Aldermen that such lands should be annexed to the City of Wichita Falls , Texas; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: SECTION 1. That the following tracts of land located in Clay and Archer Counties, Texas, be and the same are hereby ordered to be annexed and to be included within the corporate limits of the City of Wichita Falls, Texas, and the corporate limits be extended so as to include said tracts of land in Clay and Archer Counties, Texas, said lands being part of Lake Arrowhead owned by the City of Wichita Falls, Texas together with land owned by the City of Wichita Falls, Texas and the State of Texas adjoining Lake Arrowhead, and right-of-way which has been acquired by the City of Wichita Falls for the water transmission line from Lake Arrowhead to the present city limits, the same being particularly described in Exhibit A, which is attached hereto and incorporated herein as part of this ordinance. SECTION 2. Before these annexation proceedings were instituted, a public hearing was held to provide an opportunity for all interested persons to be heard, in conformity with Article 970a, Revised Civil Statutes of Texas. SECTION 3. It is the intention of the Board of Aldermen in adopting this ordinance to annex property owned by the City of Wichita Falls and property which was conveyed by the City of Wichita Falls to the State of Texas for park purposes, save and except all areas which lay inside of the municipal boundaries and the extraterritorial jurisdiction of all other incorporated cities and towns. If the field notes set out in Exhibit A include any property which is not owned either by the City of Wichita Falls, Texas or the State of Texas or which is within the boundaries or the extraterritorial jurisdiction of any other city and town, such property is hereby excepted from said field notes, and the validity of the annexation of the balance of the property shall not be affected thereby. SECTION 4. In conformity with Section 3-A of the amended Charter of the City of Wichita Falls, Texas, this ordinance is on the 17th day of July, 1973 introduced and the City Clerk is directed to publish said ordinance one (1) time in a newspaper of general circulation published in the City of Wichita Falls, Texas and seven (7) days thereafter this ordinance may be finally acted upon. SECTION 5.
