AN ORDINANCE CLOSING AND ABANDONING ALL THAT PORTION OF WICHITA
STREET LYING BETWEEN THE WEST RIGHT-OF-WAY LINE OF BRIDGE STREET
PROJECTED AND THE EAST RIGHT-OF-WAY LINE OF THE FORT WORTH AND
DENVER RAILROAD ; RETAINING CERTAIN EASEMENT RIGHTS; AND DECLARING
AN EMERGENCY.
WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas
deems it advisable and in the public interest to close that portion of Wichita
Street herein described.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. All that portion of Wichita Street lying between the west
right-of-way line of Bridge Street projected and the east right-of-way line of
the Fort Worth and Denver Railroad be and is hereby closed and abandoned.
SECTION 2. The City of Wichita Falls, Texas hereby reserves a ten
foot utility easement five feet either side of a line which is parallel to and
fifteen feet south of the north right-of-way line of the said Wichita Street.
SECTION 3. The City of Wichita Falls, Texas hereby reserves a ten
foot aerial easement five feet either side of a line which is parallel to and
fifteen feet north of the south right-of-way line of the said Wichita Street.
SECTION 4. The fact that the owner of the properties on both the
north and south sides of the street is in the process of expanding plant
processing facilities, and the project is being delayed pending the closure
of the above described portion of Wichita Street, creates an urgent public
necessity requiring that this ordinance be passed as an emergency measure, and
this ordinance is passed as an emergency measure and shall be in force and
effect immediately from and after its passage.
