Ord 2823 10/8/1973 ORDINANCE NO. ,;4;2. ORDINANCE CLOSING HEARING AND FINDING CERTAIN BUILDINGS AND/OR STRUCTURES TO BE DANGEROUS; COMMANDING PROPERTY OWNERS TO REPAIR, VACATE, OR DEMOLISH SAID BUILDINGS AND/OR STRUCTURES WITHIN THIRTY (30) DAYS OF THE DATE OF THIS ORDINANCE AND DECLARING AN EMERGENCY. WHEREAS , the Building Inspector of the City of Wichita Falls , acting under the provisions of Ordinance No. 2388 enacted by the Board of Aldermen of the City of Wichita Falls on February 12, 1968, notified in writing by certified mail the following list of property owners of the property shown that the building or buildings on the premises had been classified as a dangerous building and that certain corrections were needed to be made or the building demolished. WHEREAS , such property owners above have not complied with the directive of the Building Inspector within the sixty days allotted in Ordi- nance No. 2388; and, WHEREAS, the above listed property owners have been notified by certified mail by the Building Inspector of the time and date of a Public Hearing for the above named property owners to appear before the Board of Aldermen to show cause why such building or structure should not be repaired, vacated, or demolished in accordance with the Statement of Particulars set forth in the Building Inspector' s notice; and said Public Hearing was had and held at the time and place fixed therefor, to-wit , on the 8th day of 0 c to - ber, 1973, at 10:00 A.M. , in the Council Chambers in the City of Wichita Falls, Texas , and at such Public Hearing the following protests and objections were made, to-wit : °.7. 0L1,11_/ protested that protested that protested that protested that protested that protested that protested that protested that protested that protested that protested that and said hearing was continued until all desiring to be heard were given full and fair opportunity to be heard and the Board of Aldermen of the City of Wichita Falls having fully considered all property matters, is of the opinion that the said Hearing should be closed. NOW,THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: , • Said hearing be, and the same is hereby, closed, and the said protests and objections, and any and all other protest objections whether enumerated or not , be and the same are hereby, overruled. From the evidence presented in the aforementioned Public Hearing by the property owners appearing and the Building Inspector of the City of Wichita Falls, the building and/or structure at the location listed above with the corresponding property owner is found to be a dangerous building as defined in Ordinance No. 2388 and the property owners listed or any other person having an interest in said building as shown by the tax records of the City of Wichita Falls, are hereby commanded to repair, vacate, or demolish the building and/or structure in accordance with the Statement of Particulars set forth in the Building Inspector's notice. The property owner listed or any other person having an interest in said building as shown by the tax records of the City of Wichita Falls if further commanded to repair, vacate or demolish in accordance with the Statement of Particulars set forth in the Building Inspector' s notice within thirty (30) days from the date of this ordinance. The fact that the repair, vacation, and/or demolition of dangerous buildings is being delayed pending the taking effect of this ordinance creates an emergency for the immediate preservation of the public business place, property , health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its passage and is accordingly so ordained.
