Resolution authorizing the purchase of two 33’ Glaval Entourage
buses through TxSmartBuy (Texas Procurement and Support
Services (TPASS) Division) from National Bus Sales in the amount of
$233,102.00
WHEREAS, Texas Gov’t Code § 2155.504 provides:
Texas Gov’t Code § 2155.504. Use of Schedule by Governmental Entities.
(a) A state agency or local government may purchase goods or services directly from a vendor
under a contract listed on a schedule developed under this subchapter. A purchase authorized by
this section satisfies any requirement of state law relating to competitive bids or proposals and
satisfies any applicable requirements of Chapter 2157.
(b) The price listed for a good or service under a multiple award contract is a maximum price. An
agency or local government may negotiate a lower price for goods or services under a contract
listed on a schedule developed under this subchapter.
WHEREAS, the City Council finds that these purchases are exempt from t he
State of Texas requirements for competitive bidding because they are purchases
through TxSmartBuy (Texas Procurement and Support Services (TPASS) Division)
WHEREAS, the City Council of the City of Wichita Falls has authorized the
purchase of products through TxSmartBuy; and
WHEREAS, the City Council finds that National Bus Sales is offering the 33’
Glaval Entourage bus through TxSmartBuy, and it is in the City’s best interest to
purchase these buses in accordance with the TxSmartBuy Program.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
City staff is authorized to execute all documents necessary to purchase the
aforementioned Glaval Entourage buses from National Bus Sales through TxSmartBuy
in a total amount of $233,102.00.
PASSED AND APPROVED this the 15th day of July, 2014.
