ORDINANCE PROVIDING FOR INTERLOCAL ASSISTANCE
BY WICHITA FALLS POLICEMEN TO COUNTIES AND
OTHER MUNICIPALITIES.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
SECTION 1. By virtue of Article 999b, Revised Civil Statutes
of Texas, the Mayor is hereby authorized to provide for regularly
employed Wichita Falls policemen to assist any other county or
municipality, when in the opinion of the Mayor or other officer of
such other county or municipality who is authorized to declare a
state of civil emergency in such other county or municipality,
there exists in such other county or municipality a need for the
services of additional law enforcement officers to protect the
health, life, and property of such other county or municipality,
its inhabitants, and the visitors thereto, by reason of riot, un-
lawful assembly characterized by the use of force and violence, or
threat thereof by three or more persons acting together or without
lawful authority, or during time of natural disaster or man-made
calamity. In the event of the absence or disability of the Wichita
Falls Mayor, this authority may be exercised by the Wichita Falls
City Manager. In the event of the absence or disability of both
the Mayor and the City Manager, this authority may be exercised by
the Wichita Falls Acting City Manager, with the advice of the
Director of Public Safety or Chief of Police.
SECTION 2. While any Wichita Falls policeman is in the ser-
vice of another county or municipality pursuant to this ordinance,
he shall be a peace officer of such other county or municipality
and be under the command of the law enforcement officer therein who
is in charge in that county or municipality, with all the powers of
a regular law enforcement officer in such other county or municipal-
ity, as fully as though he were within the City of Wichita Falls.
SECTION 3. Any Wichita Falls policeman who is ordered to per-
form police duties outside the territorial limits of the City of
Wichita Falls shall be entitled to the same wage, salary, pension,
and all other compensation and all other rights for such service,
including injury or death benefits, the same as though the service
had been rendered within the limits of the City of Wichita Falls,
and shall also be paid for any reasonable expenses of travel, food,
or lodging that he may incur while on duty outside such limits.
SECTION 4. All wage and disability payments, pension payments,
damage to equipment and clothing, medical expense, and expenses of
travel, food, and lodging shall be paid by the City of Wichita Falls.
Upon making such payments, the City of Wichita Falls shall, when it
so requests, be reimbursed by the county or municipality whose auth-
orized official requested these services out of which the payments
arose.
SECTION 5. The fact that an emergency situation may arise
makes this an emergency measure, and the same shall become effec-
tive immediately.
