Ordinance closing and abandoning the remaining portions of two
alleys located at Tenth Street and Brook Street out of Block 262 in
the Thompson Subdivision, Wichita Falls, Wichita County, Texas
WHEREAS, United Regional Health Care Systems (URHCS) has requested the
closing and abandonment of the remaining 13,939.2 square feet of the two alleys
located at Tenth Street and Brook Street out of Block 262 in the Thompson Subdivision;
WHEREAS, the City Council finds that the fair market value of the property, as
determined by appraisal, is $111,514, and the adjacent property owner (United
Regional Health Care System) with the underlying fee simple has provided such sum in
exchange for the property;
WHEREAS, all affected utility companies, adjacent property owners, and City
departments have reviewed this request and recommended conditional approval to
close and abandon the remaining alleys subject to easement retention ; and
WHEREAS, the City Council finds that it is in the best public interest to close and
abandon said alleys as herein indicated on the attached Exhibit “A” Location Map,
Exhibit “B” Aerial Map, and Exhibit “C” Field Notes.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
1. The remaining portions of the two alleys located at Tenth Street and Brook
Street, Block 262, Thompson Subdivision as depicted and described in the attached
Exhibit “A” Location Map, Exhibit “B” Aerial Map, and Exhibit “C” Field Notes,
consisting of approximately 13,939.2 square feet, will be closed and abandoned with the
retention of all utility easements, in exchange for the sum of $111,514.
2. The City Manager is authorized to execute a quitclaim deed to convey the
property to the adjacent property owner with the retained utility easement in exchange
for the amounts described herein.
