ORDINANCE NO. 2853
AN ORDINANCE RELEASING AND ABANDONING ALL EASEMENT
RIGHTS TO LOT 9, BLOCK G, KEMP FAIR PARK ADDITION
TO THE CITY OF WICHITA FALLS, TEXAS, AND DECLARING
AN EMERGENCY.
WHEREAS, the Board of Aldermen of the City of Wichita Falls,
Texas, deems it advisable and in the public interest to release and
abandon all easement rights to Lot 9, Block G, Kemp Fair Park Addition.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF
THE CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. All easement rights granted to the City of Wichita
Falls by that certain instrument as executed by Walker B. Comegys, which
instrument is recorded in Volume 530, Page 586, of the Wichita County
Deed Records, for the construction, operation and maintenance of a
sanitary sewer lift station on the following described tract of land:
Lot 9, Block G, Kemp Fair Park Addition to the City of Wichita
Falls, in Wichita County, Texas,
be and the same are hereby released and abandoned.
SECTION 2. The fact that the sale of this property of the said
Kemp Fair Park Addition is being delayed pending the taking effect of
this ordinance because of the presence of the above described easement
creates an urgent public necessity, requiring that this ordinance be
passed as an emergency measure, and this ordinance is passed as an
emergency measure, and shall be in force and effect immediately from
and after its passage.
