AN ORDINANCE RELEASING AND ABANDONING ALL EASEMENT
RIGHTS TO 10 FOOT UTILITY EASEMENT CONTAINING SEWER
MAIN IN LOT 1 AND LOT 2, WILLOWBROOK ADDITION, SECTION
6, THAT WAS RETAINED IN ORDINANCE NOS. 1567 AND 2751
WHEREAS, the Board of Aldermen of the City of Wichita Falls,
Texas, deems it advisable and in the public interest to release and
abandon all easement rights to 10 foot utility easement crossing
Lot 1, and extending 90 feet into Lot 2, Block 4 of Willowbrook
Addition, Section 6, containing abandoned sewer main.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF
THE CITY OF WICHITA FALLS, TEXAS, THAT:
Section 1. All the above described easement rights in said
Lots 1 and 2 reserved by the City of Wichita Falls, by the passage
of Ordinance No. 1567, and by further passage of Ordinance No. 2751
when all streets and alleys were closed by above Ordinances, for
construction and maintenance of sanitary sewer main, be and the
same are hereby released and abandoned .
Section 2 . The fact that the financing of improvements on
Lot 2, Willowbrook Addition, Section 6, is being delayed pending
the taking effect of this Ordinance because of the presence of the
above described easement creates an urgent public necessity, requiring
that this Ordinance be passed as an emergency measure, and this Ordinance
is passed as on emergency measure, and shall be in force and effect
immediately from and after its passage.
