AN ORDINANCE ABANDONING THE CONSTRUCTION OF IMPROVE-
MENTS ON PORTIONS OF STREETS AT LOCATIONS OUT OF THE
1974 RECONSTRUCTION PAVING PROGRAM, DELETING SAME
FROM CONTRACT WITH TIMMINS-ANDERSON CORPORATION, WICHITA
FALLS, TEXAS ; AND CANCELLING THE ASSESSMENT LIENS LEVIED
AGAINST ABUTTING PROPERTIES.
WHEREAS, by Ordinance 2870, dated May 21, 1974, the Board of Aldermen
of the City of Wichita Falls, Texas, a municipal corporation, determined the
necessity of paving and constructing other improvements on portions of streets
designated as a portion of the 1974 Reconstruction Paving Program in Wichita
Falls, and a notice of such action, in accordance with Article 1220A of Revised
Civil Statutes of Texas , was filed with the County Clerk and was recorded in
Volume 669, Page 301 of the Deed of Trust Records of Wichita County; and,
WHEREAS, by Ordinance 2870, dated May 21, 197.4; the Board of
Aldermen of the City of Wichita Falls, Texas, adopted the plans and specifica-
tions and authorized for the advertisement for bids; and,
WHEREAS,there are insufficient funds for the financing of the entire
program as proposed by the bids; and,
WHEREAS, Timmins-Anderson Corporation, who have contracted with the
City for the construction of said improvements, have consented to the abandon-
. ment of the Improvements on such portions of streets.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
I.
The improvements on the following portions of streets shall be aband-
oned, and same shall be deleted from the contract with Timmins-Anderson Corp. ,
Wichita Falls, Texas, and the assessment liens heretofore levied against prop-
erties abutting such portions of streets are hereby cancelled, to-wit:
ROWLAND ROAD: From the east property line of
Perigo Street to west property
line of Windthorst Road.
• The City Clerk is hereby directed to file a notice of this ordinance
with the County Clerk of Wichita County, Texas, for the purpose of releasing
the assessment liens against such properties abutting the portions of streets
set out above.

NOTICE OF RELEASE OF ASSESSMENT
THE STATE OF TEXAS
COUNTY OF WICHITA
WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas
a municipal corporation, has heretofore ordered an assessment against certain
property abutting.streets listed below; and,
WHEREAS, notice of said assessment was dated May 21, 1974, and
recorded in Volume 669, Page 301 of the Deed of Trust Records of Wichita
County, Texas, to which reference is here made for all purposes.
WHEREAS, by Ordinance No. AM7 , dated Sept. 3, 1974 the
Board of Aldermen released such assessments against the properties abutting
the following portions of street , to-wit:
ROWLAND ROAD: From the east property line of
Perigo Street to west property
line of Windthorst Road.
NOW, THEREFORE , notice is hereby given that such assessment liens
levied against the properties abutting on the above set out portions of
street has been cancelled.
