Ord 2905 9/24/1974 ORDINANCE NO. ORDINANCE AMENDING SECTION 17-19 OF CODE OF ORDINANCES OF THE CITY OF WICHITA FALLS , IN- CREASING THE RATES FOR COLLECTION OF GARBAGE AND REFUSE, AND AMENDING SECTION 17-62, IN- CREASING LANDFILL USE FEES. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS , THAT: SECTION 1 . Section 17-19 of Code of Ordinances of the City of Wichita Falls , is hereby amended so that such section shall hereafter read as follows : "Sec. 17-19. Charges for city collection-prescribed. The rates for gathering and removal of garbage and refuse from all premises within the city shall be calculated on the following basis : (1) Single family unit served from alley or curb $2.25 per month (2) One family unit or single family unit , without alley entrance, where it is necessary to carry out refuse or garbage for more than (10) feet but less than fifty (50) feet from curb $5.00 per month (3) One family unit:or single family unit , without alley entrance, where it is necessary to carry out refuse or garbage for more than fifty (50) V feet from curb but less than one hundred (100) feet from curb $7.50 per month (4) One family unit or single family unit, without alley entrance, where it is necessary to carry out the refuse or garbage more than one hun- dred (100) feet from the curb $10.00 per month (5) Two (2) family units on one (1 ) meter $4.50 per month (6) Two (2) family units on separate meter, per unit $2.25 per month (7) Apartment houses in one building up to and in- cluding three units, per unit , each $2.25 per month Four to twelve units , each $2. 10 per month Over twelve units, each $2.00 per month (8) Housing developments where alley is available for service, per unit $2.25 per month Any housing units where alleys are not available : Ten (10) feet but less than fifty (50) feet. .$ 5.00 per month Fifty (50) feet but less than one hundred ( 100) feet $ 7.50 per month One Hundred (100) feet and over $10.00 per month (9) Any alley or easement from which sanitation service is- to be provided shall be at least fifteen (15) feet wide and provide adequate clearance so collection ve- hicles may safely negotiate said alley or easement. Any alley or easement which shall , in the opinion of Sanitation officials, become unsafe may have service discontinued and require movement of cans or recep- tacles to street collection, and fees for such ser- vice will be charged accordingly. (10) Commercial and business establishments , regardless of location shall be charged at a rate to be established by the Sanitation Superintendent on the basis of cost of service to be determined by the container volume or time consumed, but no business , commercial concern, or establishment shall be less than $5. 75 per month. Pub- lic, business , and commercial institutions will receive sanitation container system service for the removal of trash and garbage under the rates and rules hereinafter set forth, as routes for such service are established by the city. Under the sanitation container system service, the City of Wichita Falls will furnish a container or containers to be used in the collection and removal of trash and garbage. The monthly charges will be deter- mined from the schedule below. These charges are based on the container size and number of collections per week. The rate in- crease is to be determined by the above schedule. When containers can serve several adjacent business institu- tions , they will be required to use the same container and pay a pro-rata part of the charge determined accor- ding to the appropriate quantity of space used. • Additional pickups will be made at $6.00 per con- tainer, or $12.50 an hour where there are no con- tainers. (11) Services rendered outside the corporate limits shall be one and one-half (l1) times the rates set out in this section." SECTION 2. Section 17-62 of the Code of Ordinances is hereby amended so that such section shall hereafter read as follows : "Sec. 17-62. License and landfill use fees established. (a) License. The license fee for each class license shall be as listed herein. Each vehicle so licensed shall require a separ- ate fee. License Fees : Class 1 - No Charge Class 2 - No Charge Class 3 - $10.00 Class 4 - $10.00 (b) Landfill use fees. Fees for the use of the land- fill shall be at the rate of $1 .60 per ton for garbage and trash originating from within the city limits and $3.20 per ton from outside the city limits. Weights shall be determined to the nearest 1/4 ton and charged accordingly, except for loads of less than 250 pounds ; the fee for a load of less than 250 pounds originating from within the city limits shall be $.25, and such load originating from outside the city limits shall be $.50. Fees for each type license and use are as follows : (1) Residents of Wichita Falls hauling refuse from their place of residence and paying regular prescribed residential rate, any type vehicle, no charge. (2) Class 1 . $1 .60 per ton with a minimum charge of $.25 for each vehicle entering landfill , charges to be accum- ulated on a monthly basis. Monthly total will be billed subtracting the $5. 75 minimum rate for commercial estab- lishments. No monthly rate will be reduced below minimum fee but all charges in excess of the minimum fee will be added to the monthly utility bill . • (3) Class 2. $1 .60 per ton , minimum $.25 per vehicle entering landfill . Charges to be accumulated on monthly basis. Charges so accumulated will be added to the monthly utility bill . (14) Class 3. $3.20 per ton, minimum charge $.50 for each vehicle entering landfill . Fee shall be collected upon entrance to landfill by cash, coupon or prearranged charge account. (5) Class 4. Rate to be charged upon origination of gar- bage. $1 .60 per ton for inside city limits or $3.20 for outside city limits . Payment shall be on pre- arranged method, to be arranged upon issuance of license." SECTION 3. The fact that the present garbage and refuse col- lection rates are inadequate to cover the cost of providing the service creates an emergency, and this ordinance is declared to be an emergency measure, and it shall become effective November 1st , 1974.
