Ord 2916 10/22/1974 • ORDINANCE NO. W ORDINANCE ACCEPTING IMPROVEMENTS OF INDUSTRIAL DRIVE, PUCKETT ROAD AND RADIO LANE, IN THE CITY OF WICHITA FALLS, TEXAS, AS DESIGNATED IN ORDINANCE NO. 2777 AND NO. 2781 DECLARING THE CONTRACT WITH TIMMINS-ANDERSON CORPORATION, WICHITA FALLS , TEXAS FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION; AND DELIVERY OF CER TIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY CLERK TO ENGROSS AND ENROLL THIS ORDINANCE BY COPY- ING THE CAPTION OF SAME IN THE MINUTE BOOK. OF THE BOARD - OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Wichita Falls, Texas, has heretofore entered . into a contract with Timmins-Anderson Corporation, Wichita Falls, Texas for the making and constructing of certain street improvements on the hereinafter described portions of streets, avenues, and public places in said City, to wit: INDUSTRIAL DRIVE: From the west property line of Radio Lane to the west property line of Loop 11. PUCKETT ROAD: From 5' west of east property line of Hooper Drive to west property line of Burkburnett Hwy. (U.S. Hwy. 277 & 281) . ' RADIO LANE: From the south property line • of Industrial Drive to the South property line of F.W. & D.R.R. WHEREAS, by sundry proceedings heretofore passed by the Board of Aldermen of the City of Wichita Falls, Texas, including Ordinance No. 2797 a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above assessed portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas has upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 2797, and, WHEREAS, the street improvements hereinabove mentioned have been comp- leted upon each of the portions of streets, avenues, and public places herein- above described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS THAT: I. The improvements on each of the portions of streets, avenues, and public places hereinabove described by and they are hereby, accepted ; and the contract with reference thereto be, and is hereby, found and declared fully completed and performed. • II. The assessments as levied by Ordinance No. 2797 shall be computed for each property owner and the same together with the Engineer's roll on Industrial Drive, Puckett Road and Radio Lane herein accepted shall be deliver- ed to the Tax Assessor-Collector, and he shall prepare statements which shall be sent to the property owners. • III. The City Clerk is hereby directed to engross and enroll this Ordi- nance by copying the caption of same in the Minute Book of the Board of Alder- _ ment of the City of Wichita, Falls, Texas, and filing the complete ordinance in the appropriate Ordinance Records of said City. IV. This ordinance shall take effect and be in full force and effect from and after the date of its passage.
