AN ORDINANCE GRANTING AUTHORITY TO THE
FIRST-WICHITA NATIONAL BANK TO LAY A
PNEUMATIC TUBE WITHIN THE SEVENTH STREET
AND SCOTT STREETS RIGHTS-OF-WAY.
WHEREAS, The First-Wichita National Bank is in the
process of planning for the construction of a new drive-
in facility on Block 141 of the Original Town of Wichita
Falls, and, in order to comply with the Texas Banking Code,
the bank desires to lay a pneumatic tube beneath Seventh
Street and Scott Street to connect the new drive-in facil-
ity with the bank' s central building.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDER-
MEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The First-Wichita National Bank is hereby
granted the right and authority to construct, maintain and
operate a pneumatic tube in and under the Seventh Street
and Scott Street rights-of-way, connecting such drive-in
facility with the bank' s central building. Such pneumatic
tube shall be constructed in the manner and location as
shown in a drawing dated November 13th, 1974 by Killebrew/
Rucker/Associates, architects, a copy of a part of which is
attached hereto.
SECTION 2 . Such bank shall coordinate such project with
all utility companies whose facilities are located under such
streets.
SECTION 3. It shall be the duty of such bank at all
times to maintain said pneumatic tube at its own expense.
If at any time in the future some public use of such rights-
of-way makes it necessary that the said tube be relocated or
removed, such relocation or removal shall be done at the sole
cost and expense of such bank.
SECTION 4. Whenever any work is being done on the con-
struction or maintenance of said tube, The First-Wichita
National Bank shall take all the necessary and proper pre-
cautions to protect the public from damage, and said bank
shall hold and save the City of Wichita Falls harmless from

all damages, or claims for damages, resulting from the con-
struction, maintenance and operation of said tube.
SECTION 5. The right and authority hereby granted is
for so long as said pneumatic tube is used and maintained as
a connection between such drive-in facility and the bank' s
central building.
