AN ORDINANCE GRANTING AUTHORITY TO THE
CITY NATIONAL BANK TO LAY A PNEUMATIC
TUBE WITHIN THE LAMAR STREET RIGHT-OF-
WAY.
WHEREAS, the City National Bank is constructing a new
drive-in facility on Block 173 of the Original Town of Wichita
Falls, and the bank desires to lay a pneumatic tube beneath
Lamar Street between Block 173 and Block 174 to connect the
new drive-in facility with the bank' s present facilities on
Block 174 of the Original Town.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDER-
MEN OF THE CITY OF WICHITA FALLS, THAT:
SECTION 1. The City National Bank is hereby granted
the right and authority to construct, maintain and operate
a pneumatic tube in and under the Lamar Street right-of-way
between Blocks 173 and 174 of the Original Town, connecting
such drive-in facility with the bank' s present facilities.
Such pneumatic tube shall be constructed at the location
shown in the attached drawing, and in a manner to be approved
by the City' s Director of Public Works.
SECTION 2 . Such bank shall coordinate such project
with all utility companies whose facilities are located under
such streets.
SECTION 3. It shall be the duty of such bank at all
times to maintain said pneumatic tube at its own expense. If
at any time in the future some public use of such rights-of-
way makes it necessary that the said tube be relocated or re-
moved, such relocation or removal shall be done at the sole
cost and expense of such bank.
SECTION 4. Whenever any work is being done on the con-
struction or maintenance of said tube, City National Bank shall
take all the necessary and proper precautions to protect the
public from damage, and said bank shall hold and save the City
of Wichita Falls harmless from all damages, or claims for dam-
ages, resulting from the construction, maintenance and opera-
tion of said tube.
SECTION 5. The right and authority hereby granted is
for so long as said pneumatic tube is used and maintained as
a connection between such drive-in facility and the bank' s
present facilities.
