Ord 2948 2/18/1975 ORDINANCE NO. WO AN ORDINANCE ADDING NEW SECTIONS 29-91. 1 and 29-91.2 TO THE CODE OF ORDINANCES OF THE CITY OF WICHITA FALLS, TEXAS, ESTABLISHING PRIMA FACIE MAXIMUM SPEED LIMITS AT CERTAIN TIMES IN CERTAIN ZONES, PROVIDING FOR REGULATION OF SPEED BY VARIABLE SIGNS, AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS , THAT: SECTION 1. A new Section 29-91. 1 is hereby added to Chapter 29 of the Code of Ordinances of the City of Wichita Falls and shall read as follows : "Sec . 29-91 . 1 . Maximum Speed Limits at Certain Times in Certain Zones . It is hereby deemed upon the basis of an engineering and traffic investigation that the speed permitted by state law and/or city ordinance upon certain streets is more than is necessary for safe operation of vehicles thereon during certain hours of the day due to the particular hazards existing during those hours . It is hereby declared that the prima facie speed limits are altered on those streets set out in the schedule in this section during the hours of 7 : 30 a.m. to 9:00 a.m. and 2 : 30 p.m. to 4:00 p.m. when signs are erected giving notice thereof. At all hours other than those set forth above, the prima facie speed limits at the loca- tions below shall revert to the prima facie limits previously established by state law and/or ordinance. (A) 20 MPH Avenue K from Arthur Street to Hayes Street . (B) 20 MPH Midwestern Parkway from Manor to Southmoor Lane. (C) 20 MPH Missile Road from a point 500 feet east of Hooper Drive to a point 500 feet west of Hooper Drive." SECTION 2 . A new Section 29-91.2 is hereby added to Chapter 29 of the Code of Ordinances of the City of Wichita Falls and shall read as follows: "Sec. 29-91.2 . Regulation of Speed by Variable Signs . The city traffic engineer is authorized to use variable message traffic signs , as hereinafter described, to indicate speed limits in the zones set out in Section 29-91. 1 where there is a need to indicate different speed limits at particular times of the day due to hazards existing during those hours. Such different speed limit is hereinafter referred to as a temporary speed limit. The variable message traffic signs shall be designed in a manner approved in the 'Manual on Uniform Traffic Control Devices for Streets and Highways ' and shall consist of a standard with yellow flashing lights and sign faces which can be alternated by mechani- cal means. When the temporary speed limit is in effect, the sign face shall be changed to so indicate; and the yellow flashing lights shall be activated. At all other times, the regularly established prima facie speed limit sign shall be displayed; and the yellow lights shall not be activated." SECTION 3. The fact that the prima facie speed limits set out in this ordinance are necessary to the safe and orderly move- ment of traffic upon the streets of the City of Wichita Falls and because it is deemed necessary to regulate the speed of vehicles through the use of variable signs, this ordinance is delcared to be an emergency measure on the ground that there is an urgent pub- lic need for the orderly flow of traffic upon the streets and a public need for the preservation of the peace, health, and safety of the lives and property of the citizens of the City.
