ORDINANCE NO. r 0. 9-1
AN ORDINANCE GRANTING AUTHORITY TO THE FOSTER CATHEAD
COMPANY TO CONNECT PRIVATE UTILITIES ACROSS THE PUBLIC
ALLEY IN BLOCK 111 OF FLORAL HEIGHTS ADDITION , CITY OF
WICHITA FALLS , TEXAS.
WHEREAS , The Foster Cathead Company is in the process of constructing
additional facilities on Lot lA of Block 111 , of the Floral Heights Addition of the
City of Wichita Falls , and desires to connect their utilities system to an existing
building on. Lot 16A, across the alley from the new facility.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS, TEXAS , THAT:
SECTION 1 . The Foster Cathead Company is hereby granted the right
and authority to construct , maintain and operate private utility lines across and
under the alley between Lot IA and Lot 16A of Block 111 , Floral Heights Addition of
the City of Wichita Falls , connecting their existing facilities to the new facility ,
presently under construction. Such utilities shall be constructed in the manner and
location shown in a drawing dated March 3 , 1975 , a copy of which is attached hereto.
SECTION 2. Said company shall coordinate such project with all util -
ity companies whose facilities are located under such alleyway.
SECTION 3. It shall be the duty of said company at all times to main-
tain said utilities at its own expense. : f at any time in the future some public
use of such right-of-way makes it necessary that the said utilities be relocated
or removed, such relocation or removal shall be done at the sole cost and expense
of such company.
SECTION 4. Whenever any work is being done cn the construction or
maintenance of said utilities , the Foster Cathead Company shall take all necessary
and proper precautions to protect the public from damage, and said company wall
hold and save the City of Wichita Falls harmless from all damages or claims from
damages , resulting from the construction, maintenance and operation of said utili-
ties.
SECTION 5. The right and authority hereby granted is for so long as
said utilities is used and maintained as a connection between Foster Cathead Company
buildings .
