ORDINANCE RELEASING LIEN AND OBLIGATION
TO CONSTRUCT STREET ON 6. 15 ACRE TRACT
OUT OF BLOCKS 42 AND 86 OF THE HIGHLAND
IRRIGATION SUBDIVISION.
WHEREAS, by instrument dated February 9th, 1966, James
R. Seitz , Jr. granted to the City of Wichita Falls a lien upon
the following described tract of land to assure the dedication
and building of a fifty (50) foot wide access street connecting
Gladney Lane or Beefeater Drive to Archer Street, to-wit:
A tract of land containing 6. 15 acres out
of Blocks 42 and 86 of the Highland Irri-
gation Subdivision of the Cyrus Eakman
Survey in Wichita Falls, Wichita County,
Texas, said 6. 15 acre tract of land being
described by metes and bounds in said in-
strument dated February 9th, 1966, which
is recorded in Volume 136, Page 208 of the
Mechanic' s Lien Records in the Office of
the County Clerk of Wichita County, Texas,
reference to which record is here made for
a complete description thereof.
WHEREAS, there no longer exists any need for such access
street, and the Planning Board of the City of Wichita Falls has
recommended that such obligation and lien be released.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF
THE CITY OF WICHITA FALLS, TEXAS, THAT:
James R. Seitz, Jr. and his assigns are hereby released
from the obligation of building such street, and the City of
Wichita Falls does further release and relinquish unto James R.
Seitz, Jr. , his heir and assigns, the above described lien which
was granted upon said 6. 15 acre tract of land in the instrument
recorded in Volume 136 , Page 208 of the Mechanic' s Lien Records
of Wichita County.
