Ord 2969 4/22/1975 ORDINANCE NO. W ORDINANCE ACCEPTING IMPROVEMENTS OF SUNSET DRIVE IN THE CITY OF WICHITA FALLS, TEXAS, AS DESIGNATED IN ORDINANCE NO. 2777 DECLARING THE CONTRACT WITH TIMMINS-ANDERSON CORPORATION, WICHITA FALLS, TEXAS FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION, AND DELIVERY OF CERTIFICATES IN EVID- ENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS ; DIRECT- ING THE CITY CLERK TO ENGROSS AND ENROLL THIS ORD- INANCE BY COPYING THE CAPTION OF SAME IN THE MIN- UTE BOOK OF THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Wichita Falls, Texas, has heretofore entered into a contract with Timmins-Anderson Corporation, Wichita Falls, Texas for the making and construcing of certain street improvements on the hereinafter described portions of streets, avenues, and public places in said City, to wit: SUNSET DRIVE: From north property line of Fifth Street to 163' north of north property line of Third Street. WHEREAS, by sundry proceedings heretofore passed by the Board of Aldermen of the City of Wichita Falls , Texas, including Ordinance No. 2797 a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above assessed portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas has upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ord- inance No. 2797, and, WHEREAS, the street improvements hereinabove mentioned have been comp- leted upon each of the portions of streets, avenues, and public places herein- above described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS THAT: I. The improvements on each of the portions of streets, avenues , and publice places hereinabove described be and they are hereby, accepted; and the contract with reference thereto be, and is hereby, found and declared fully completed and performed. II. The assessments as levied by Ordinance No. 2797 shall be computed for each property owner and the same together with the Engineer's roll on Sunset Drive herein accepted shall be delivered to the Tax Assessor-Collector, and he shall prepare statements which shall be sent to the property owners. III. The City Clerk is hereby directed to engross and enroll this Ordinance by copying the caption of same in the Minute Book of the Board of Aldermen of the City of Wichita Falls, Texas, and filing the complete ordinance in the appropriate Ordinance Records of said City. IV. This ordinance shall take effect and be in fullforce and effect from and after the date of its passage. PASSED AND APPROVED THIS 22nd DAY OF April 1975 M A Y O R ATTEST: ,`/'?
