ORDINANCE AMENDING PARAGRAPH 5 OF SECTION F
OF THE 1962 EDITION OF THE UNITED STATES
PUBLIC HEALTH SERVICE FOOD SERVICE SANITA-
TION ORDINANCE AND CODE, ADOPTED BY SECTION
16-1 OF THE CODE OF ORDINANCES OF THE CITY
OF WICHITA FALLS, TO ALLOW THE ESTABLISHMENT
OF PET SHOPS IN SHOPPING CENTERS, INCLUDING
ANY OPEN AND/OR ENCLOSED MALL SHOPPING CENTER,
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
SECTION 1. Paragraph 5 of Section F of the 1962 Edition
of the United States Public Health Service Food Service Sanita-
tion Ordinance and Code, which is adopted by Section 16-1 of the
Code of Ordinances of the City of Wichita Falls, is hereby amended
by adding the following as the last sentence to such Paragraph:
"And further provided, that nothing contained in this
Paragraph shall be construed to prohibit the establishment of a
pet shop in a shopping center, including any open and/or enclosed
mall shopping centers when the following conditions are met: (1)
The pet shop is completely enclosed and has a self-closing door
into the mall, which door is kept closed when not actually in
use; (2) The air in the pet shop is mechanically exhausted to
the outside and not into the mall; (3) The pet shop shall have
a door opening to the outside of the mall and all animals and
pets which have been purchased from the pet shop shall be re-
moved from the shop through that exit; (4) All animals shall be
confined behind effective odor free barriers. "
SECTION 2. This ordinance is declared to be an emergency
measure on the ground of urgent public need for the preservation
of the peace, health and safety of property of the City, and the
same shall become effective immediately on its passage.
