ORDINANCE GRANTING WAIVER OF SECTION
8-2 AND 27-5 OF THE CODE OF ORDINANCES
ON JULY 19 , 1975 FOR ANNUAL SIDEWALK
SALE IN THE CENTRAL BUSINESS DISTRICT.
WHEREAS, The Downtown Association has requested per-
mission to hold its annual sidewalk sale on July 19, 1975
in the Central Business District; and,
WHEREAS, Section 8-2 of the Code of Ordinances con-
trols the advertising and selling of goods on public right-
of-way, and Section 27-5 restricts the storage of equipment
and goods on streets and sidewalks.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN
OF THE CITY OF WICHITA FALLS, TEXAS, THAT:
The provisions of said Section 8-2 and Section 27-5 of
the Code of Ordinances is hereby waived for the purpose of
allowing the annual sidewalk sale on July 19 , 1975 in the
Central Business District; provided, however, that each mer-
chant who participates in the sale shall take every precaution
to make sure that the sidewalk in front of his store is safe
for pedestrians, and he shall not allow his merchandise to
be placed on the sidewalk in such a manner that it constitutes
a hazard; further, each merchant participating in such sale
shall indemnify the City from all liability for damages arising
out of the use of the sidewalk for the display and sale of
merchandise.
