ORDINANCE AMENDING SECTION 4-18 OF THE CODE
OF ORDINANCES TO ALLOW, IN CERTAIN CIRCUM-
STANCES, A BUILDING IN WHICH ALCOHOLIC BEV-
ERAGES ARE SOLD, TO BE LOCATED MORE THAN
TWO HUNDRED (200) FEET FROM THE STREET RIGHT-
OF-WAY.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
Section 4-18 of the Code of Ordinances (being Section
4 of Ordinance No. 2491) is hereby amended so that the last
paragraph thereof, being that portion following the enumera-
tion of highways, shall read as follows :
" (These streets are marked on a map which is on file
in the office of the City Clerk. ) Provided, however, where
the topography of the land and/or the relationship between
the size and type of the improvement and other City ordi-
nances affecting building lines, off-street parking area, and
other features of the improvement on the premises under con-
sideration prevents the practical location of such building
from being within the two hundred (200) foot limitation, such
two hundred (200) foot limit shall be extended to such dis-
tance as the Planning Department determines is practicable to
allow such sales and maintain the spirit of the ordinance.
If such a retail dealer is located in a shopping center which
abuts on one of said streets, such sales shall be allowed in
a building that is located more than two hundred (200) feet
from such right-of-way line. "
