RESOLUTION AUTHORIZING THE PUBLICATION OF
NOTICE OF INTENTION TO LEASE FOR OIL AND
GAS CERTAIN LANDS LOCATED AT LAKE KICKAPOO
IN ARCHER COUNTY, TEXAS.
WHEREAS, the City of Wichita Falls has received a request
that certain lands owned by the City at Lake Kickapoo in
Archer County, Texas, be leased for oil and gas exploration
and production.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN
OF THE CITY OF WICHITA FALLS, TEXAS , THAT:
SECTION 1. It is advisable, under proper circumstances,
to lease for the development of oil and gas all, or part,
of the following tracts of land located at Lake Kickapoo,
Archer County, Texas, to-wit:
364 . 8 acres, more or less, in four tracts,
all of which are described by metes and
bounds in Exhibit A, which is attached
hereto and incorporated herein by reference.
SECTION 2 . Any such oil and gas lease shall provide for
at least 1/8 royalty, and shall have a primary term of no
more than 10 years.
SECTION 3. Any such oil and gas lease may include a
pooling provision which meets with the requirements of
Subchapter B of Chapter 71 of the Natural Resources Code
of the State of Texas.
SECTION 4 . Under any such oil and gas lease, no actual
drilling may occur on the property covered by such lease
unless the location of such well is approved in advance by
the City, and meets the specifications designated for
protecting the water in the lake; provided, however, such
provision would not prohibit the drilling of a well on
other lands with which a portion of the leased property
was pooled nor the drilling of a directional well under
such property.
SECTION 5. City shall give notice of intention to lease
such lands by publication once a week for three consecutive
weeks in a newspaper published in the County, which notice
shall describe the land and designate the time and place
at which the Board of Aldermen will receive and consider
bids for such lease.
SECTION 6. City will not warrant the title to
minerals in such lands .
SECTION 7 . The Board of Aldermen reserves the right
to reject any and all bids, and to give notice and call
for additional bids, if same is determined to be in the
best interest of the City.

the same land conveyed by a Warranty Deed from Etta Forgy to E. R. Fain
April 14, 1924, and recorded in Page 341, Volume 81 of the Deed Records of
Archer County, Texas:
BEGINNING at a point on the North line of the G. W. Dugan
Survey, Abst. 1193, and running thence North 637. 6 feet to
a point on the South line of Survey No. 174 , in the name
of Robert Carson; Thence West with the South line of the
Robert Carson Surveys Nos. 174 and 175, 4286 feet to a stone
the N.W. corner of this survey and the S.W. corner of the
Robert Carson Survey No. 175; Thence South 656. 3 feet to a
point on the North line of the said G. W. Dugan Survey, the
said point being the S.E. corner of the J. D. Lyles Survey,
Abst. 1105; Thence East with the North line of the said
Dugan Survey 4300 feet to the place of beginning and contain-

Being the same land described in Deed dated September 15,
1944, recorded in Volume 199, Page 256 of the Deed Records
of Archer County, Texas wherein Fain & McGaha et al conveyed
such land to the City of Wichita Falls.
2. All that certain lot, tract and parcel of land situated in
Archer County, Texas, to-wit:
Being fifty and 7/10 (50. 7) acres of land, more or less, out
of Blk. No. 26 of the Harris Subd. of the Club Ranch, de-
scribed by metes and bounds as follows:
BEGINNING at the N.E. corner of the G. W. Dugan Sur. , Abst.
1193, the same being the N.W. corner of the T. P. Martin
Sur. , Abst. 739 and running thence E. 1110. 8 ft. to the N.E.
corner of the said Martin Sur. ; Thence S. with the E. line
of the said Martin Sur. and the W. line of Blk. 26 of the
Harris Subd. of the Club Ranch 1400 ft. to a point; Thence
E. 600 ft. to a point; Thence N. 2024 . 8 ft. to a point in
the S. line of the Robt. Carsons Surveys, No. 174; Thence
W. with the S. line of the said Carson Surveys 2188.4 ft.
to a point; Thence S. 624.8 ft. to a point on the N. line
of the G. W. Dugan Sur. , Abst. 1193; Thence E. with the N.
line of the said Dugan Sur. 477.6 ft. to the place of be-
ginning. Containing 50.7 acres of land, more or less.
Being the same land described in Deed dated November 20, 1944,
recorded in Volume 198 , Page 392 of the Deed Records of Archer
County, Texas wherein L. T. Burns conveyed such land to the
City of Wichita Falls.

of the T. P. Martin Survey, Abst. No. 739, Archer County, Texas, and
described by metes and bounds as follows:
BEGINNING at the N.W. corner of the T. P. Martin Survey,
Abst. 739, the same being the N.E. corner of the G. W.
Dugan Survey, Abst. 1193 and running thence South with
the West line of the said Martin Survey 2009.6 feet to a
point; Thence East 1110. 8 feet to a point in the East line
of the said Martin Survey, the same being the West line of
Block 26 of the Harris Subdivision of the Club Ranch; Thence
North with the East line of the said Martin Survey 2000 feet
to the N.E. corner of the said survey; Thence West 1110. 8
feet to the place of beginning. Containing 51.1 acres of
land, more or less.
Being the same land described in Deed dated September 6, 1945,
recorded in Volume 202, Page 320 of the Deed Records of Archer
County, Texas wherein H. M. McCarty conveyed such land to the
City of Wichita Falls.
4. A tract or parcel of land out of, and being a part of the
G. W. Dugan Survey, Abst. No. 1193, Archer County, Texas, more fully de-
scribed as follows:
BEGINNING at a point in the South line of the B. P. Cochran
Survey, the same being the N.E. corner of the G. W. Dugan
Survey, Abst. 1193, and the N.W. corner of the T. P. Martin
Survey, Abst. 793; Thence South with the East line of the
said Dugan Survey and the West line of the said Martin Sur-
vey, 2009. 6 feet to a point; Thence West 1600 feet to a
