RESOLUTION APPROVING FIRST AMENDMENT
TO WATER PURCHASE CONTRACT WITH FRIBERG-
COOPER WATER SUPPLY CORPORATION.
BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS , TEXAS , THAT:
That certain First Amendment to Water Purchase Contract ,
a copy of which is attached hereto , between the City of
Wichita Falls and Friberg-Cooper Water Supply Corporation, is
hereby approved, and the City Manager is authorized to
execute the same for the City of Wichita Falls.
Passed and approved this the 1st day of December , 1981 .

This First Amendment to Water Purchase , ntrant made
and entered into this the 1st day of December, 1981, b and
between the City of Wichita Falls, Texas and Friberg-•Cooper
Water Supply Corporation,
WITNESSETH:
WHEREAS, under date of June 15, 1979, the City of
Whichita Falls and Friberg-Cooper Water Supply Corporation
entered into a water purchase contract, and the parties desire
to amend such contract.
NOW THEREFORE, the parties hereto do hereby agree as
follows:
Section 5.0 of said contract dated June 15, 1979 is hereby

amended to read as follows:
Section 5.0: Friberg shall permit the water to be used
only for normal residential and commercial purposes. Unless
written permission is obtained from City, water shall not be
used for extensive agricultural irrigation, or by any processing r
or manufacturing concern which uses such water in substantial
ff
quantities or for other municipalities and/or residential and/or

commercial subdivision. Such permission will not be given to
serve a subdivision unless the subdivision complies with the
Subdivision Regulations, Building Code, Electrical Code, Plumbing I
Code and any other ordinances or regulations which apply in the
City of Wichita Falls. No connections shall be made to existing p
water service lines located in or extensions made into aircraft
accident potential and/or noise zones of Sheppard Air Force Base

without specific approval of the City. Such zones shall be those
shown in the most recent Air Installation Compatible Use Zone r;,,,;.,:.,;y_. _:; •_.";_

sell any water to any private party for resale by such private
parties to third parties. Friberg shall be allowed to make single f
connections to the Friberg system with notification to the City
of such action, provided the maximum daily allowable as set out
