ORDINANCE ACCEPTING. IMPROVEMENTS OF FIVE (5) UNITS
OF THE 1973 ASSESSMENT PAVING PROGRAM IN THE CITY OF
WICHITA FALLS, TEXAS, AS DESIGNATED IN ORDINANCE NO.
2776 DECLARING THE CONTRACT WITH SABRE ASPHALT COMPANY
WICHITA FALLS, TEXAS, FOR THE CONSTRUCTION OF SAID
IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECT-
ING THE ISSUANCE , EXECUTION AND DELIVERY OF CERTIFI-
CATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER
GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND
ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE
CITY CLERK TO ENGROSS AND ENROLL THIS ORDINANCE BY COPY-
ING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE BOARD
OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS AND BY
FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE
RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Wichita Falls, Texas has heretofore entered
into contract with Sabre Asphalt Company, Wichita Falls, Texas for the making
and constructing of certain street improvements on the hereinafter described
portions of streets, avenues and public places in the City to-wit:
BRICK STREET: From the south property line
of Humphreys Street to south
property line of Eastside
Drive.
CLEVELAND AVENUE: From the north property line
of Barwise Street to south
property line of Eastside
Drive.
OWENS STREET: From the south property line
of Barwise Street to the south
property line of Eastside Drive
TWENTY-EIGHTH From the east property line of
STREET: Travis Street to 7.0 ft. east of
the east property line of Lamar
Street.
TWENTY-THIRD From the welt property line of
STREET: Broad Street to the west prop-
erty line of Jasper Street.

. • WHEREAS, by sundry proceedings heretofore passed by the Board
of Aldermen of the City of Wichita- Falls, Texas, including Ordinance No.
2796, a portion of the cost of said improvements was levied and assessed
against the respective properties abutting on each of the above assessed
and public places and against the real an
portions of streets , avenues nd p l c p g and
'true owners thereof; and, 0
• WHEREAS ,the Board of Aldermen of the City of Wichita Falls, Texas,
has upon review, found and determined that, in some instances in order to
.effect substantial justice and equality, 'it is desireable and necessary to
• grant and issue certain credits against some one or more of the assessments
levied by Ordinance No. 2796; and,
•
WHEREAS , the street improvements hereinabove mentioned have been
completed upon each of the portions of streets , avenues and public places
• hereinabove described , and have been inspected and found to be in complete
accordance with the contract therefor: .

NOW, THEREFORE , •
•
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
I.
The improvements on each of the portions of streets , avenues and
public places hereinabove described be , and they are hereby accepted ; and
the contract with reference thereto be, and is hereby found and declared
fully completed and performed.
' II.
The assessments as levied by Ordinance No. 2796 shall be computed
for each property owner and the same together with the Engineer' s Rolls of
: five (5) of the fifty-five locations herein accepted shall be deliver-
ed to the Tax-Assessor-Collector, and he shall prepare statements which shall
be sent to the property owners.
III.
The City Clerk is hereby directed to engross and enroll this Ordi-
nance by copying the caption of same in the Minute Book of the Board of Alder-
men of the City of Wichita Falls, Texas, and by filing the completed ordinance
in the appropriate Ordinance Records of said City.
IV.
This Ordinance shall take effect and be in full force and effect
• from and after the date of its passage.
