ORDINANCE GRANTING WAIVER OF SECTION 8-2 and 27-5 OF
THE CODE OF ORDINANCES ON OCTOBER 4, 1975 FOR ANNUAL
SIDEWALK ART SALE IN THE CENTRAL BUSINESS DISTRICT.
WHEREAS, The Wichita Falls Art Association has requested permission to hold its
annual Top O'Texas Art Show and sale on October 4, 1975 in the Central Business District;
and,
WHEREAS, Section 8-2 of the Code of Ordinances controls the advertising and selling
of goods on public right-of-way, and Section 27-5 restricts the storage of equipment and
goods on streets and sidewalks.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The provisions of said Section 8-2 and Section 27-5 of the Code of Ordinances is
hereby waived for the purpose of allowing the annual Top O'Texas Art Show and sidewalk
sale on October 4, 1975 in the Central Business District; provided, however, that the
Wichita Falls Art Association and its participants shall take every precaution to make
sure that the sidewalk is safe for pedestrians, and shall not allow merchandise to be placed
on the sidewalk in such a manner that it constitutes a hazard; further, the Wichita Falls
Art Association and the participants in the Top O•Texas Art Show and sale shall indemnify
the City from all liability for damages arising out of the use of the sidewalk for the display
and sale of merchandise.
