Ord 3021 10/7/1975 ORDINANCE NO. ORDINANCE GRANTING AUTHORITY TO THE CITY NATIONAL BANK TO CONSTRUCT A CANOPY OVER THE SIDEWALK IN THE 800 BLOCK OF 8TH STREET. WHEREAS, City National Bank is remodeling its office building which is located at the corner of 8th and Scott Streets in Wichita Falls, and it desires to construct a canopy over the sidewalk at the 8th Street entrance to the building; and, WHEREAS, Section 2201. 2 of the Building Code provides that canopies shall be entirely supported from the building, and shall not extend more than two-thirds of the width of the sidewalk measured from the building. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. City National Bank is hereby granted the right and authority to construct a canopy from the 8th Street entrance to the building out to the curb line, supported by posts; such canopy shall be constructed in the manner and location shown in the drawing, a copy of which is attached hereto, prepared by Page,Sutherland and Page, Architects, Engineers and Consultants. SECTION 2. Said Bank shall coordinate such project with all utility companies whose facilities are located in the 8th Street right-of-way. SECTION 3. It shall be the responsibility of the Bank at all times to maintain said canopy at its own expense. If at any time in the future some public use of such right-of-way makes it necessary that the canopy be relocated or removed, such relocation or removal shall be done at the sole cost and expense of the Bank. SECTION 4 . Whenever any work is being done on the con- struction or maintenance of said canopy, the Bank shall take all necessary and proper precautions to protect the public from damages. The Bank shall hold and save the City of • • . Wichita Falls harmless from all damages or claims for damages resulting from the construction, maintenance and location of such canopy. SECTION 5. The right and authority hereby granted is for so long as said canopy is used and maintained by said Bank. When the canopy is no longer so used, it shall be removed by the Bank at its sole cost and expense.
