Ord 3042 12/16/1975 ORDINANCE NO. 3042 ORDINANCE AMENDING SUBSECTION (1) OF SECTION 7-15 OF THE CODE OF ORDINANCES, ESTABLISHING BUILDING SETBACK LINES. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: Subsection (1) of Section 7-15 of the Code of Ordinances is hereby amended to read as follows: " (1) Amend Section 105 by adding Section 105. 8 to read as follows: 'Front, side and back building setback lines. (a) Except in the Fire Districts, no building, shed or open shed shall be erected closer to the property line than the building setback lines herein established. (b) If a front building setback line is shown on the subdivision plat, such line is hereby established as the front building setback line. If no front setback line is shown on the subdivision plat, but there are two or more existing principal buildings on the same side of the street on the same block and fronting on such street, then the front setback line is hereby established at the same distance from the front property line as the average existing setback of such existing buildings. If the front setback line is not established by the subdivision plat, and has not been established by existing buildings, the front building setback line is hereby established twenty-five (25) feet from the front property line. (c) If the exterior side building setback line on a corner lot is shown on the subdivision plat, it is hereby established as the exterior side setback line. If the exterior side setback line on a corner lot is not shown on the subdivision plat, and if interior lots have been platted fronting on the side street in the same block on the same side of the street, the exterior side setback line for such a corner lot is hereby established ten (10) feet closer to the side property line than the front setback line for the said interior lots, but in no event closer than ten (10) feet to such side property line. If the exterior side setback line on a corner lot is not shown on the subdivision plat, and if interior lots have not been platted fronting on such side street in the same block on the same side of the street, the exterior side setback line for such a corner lot is hereby established ten (10) feet from the side property line. (d) If the side setback line on interior lots is shown on the subdivision plat, it is hereby established as such interior side setback line. If the side setback line on interior lots is not shown on the subdivision plat, the side setback line on interior lots is hereby established five (5) feet from the side property line. However, a detached building containing no more than one hundred fifty (150) square feet, constructed of non-combustible materials, located on the rear one quarter of the lot may be built within three (3) feet of the side lot line. (e) If a back building setback line is shown on the subdivision plat, it is hereby established as the back building setback line. If such back building setback line is not shown on the subdivision plat, the back building setback line is hereby established five (5) feet from the back property line; however, a detached building containing no more than one hundred fifty (150) square feet, constructed of non-combustible materials, located on the rear one quarter of the lot, may be built within three (3) feet of the back property line. Provided, however, if an alley or a utility easement abuts the back property line of the lot, then the back building setback line is hereby established one (1) foot from the right-of-way line of the alley or utility easement, but the roof overhang shall not extend over the alley or easement. r . ,, r (f) The following exceptions shall apply to roof overhangs and carports: 1. A roof overhang may extend four (4) feet beyond the front setback line, if such overhang is unsupported. 2 . A carport may extend as much as ten (10) feet, but no more, in front of a front building setback line, but under this exception no carport shall be built closer than twenty-five (25) feet to the front property line; further, any part of a carport that so extends beyond the front building setback line shall not be enclosed with walls.
