Ord 3064 3/2/1976 ORDINANCE NO. 4'1 '5/ ORDINANCE GRANTING AUTHORITY TO C. 0. MORGAN TO CONSTRUCT A SIGN ON A UTILITY EASEMENT ON LOT 1 OF THE MORGAN SUBDIVISION. WHEREAS, C. O. Morgan is constructing, to be used for his business, certain improvements on Lot 1 of the Morgan Subdivision, a replat of part of Block 12, Sayles Irrigation Subdivision of the J. A. Scott Survey No. 10 , A-302, and he desires to construct a sign on a utility easement located on this property, which utility easement abuts the South Freeway; and, WHEREAS, the subdivision ordinance, No. 2118, provides that structures of a permanent nature shall not be placed upon utility easements; and, WHEREAS, only a sanitary sewer line is located in this easement; all other utilities are already installed and none have been placed in this easement. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. C. O. Morgan is hereby granted the right and authority to construct a sign on such utility easement at a location approved by the City Director of Public Works. SECTION 2. It shall be the responsibility of C. O. Morgan at all times to maintain said sign at his own expense. If at any time in the future some use of such easement by utilities makes it necessary that such sign be relocated or removed, such relocation or removal shall be done at the sole cost and expense of C. O. Morgan. SECTION 3. Whenever any work is being done on the construction or maintenance of said sign, C. O. Morgan shall take all necessary and proper precautions to protect the utilities from damages. C. 0. Morgan shall hold and save the City of Wichita Falls harmless from all damages or claims for damages resulting from the construction, maintenance and location of said sign. SECTION 4. The right and authority hereby granted is for so long as said sign is used and maintained by C. O. Morgan. When the sign is no longer so used, it shall be removed by C.O.
