AN ORDINANCE AMENDING SECTION 2-133, SECTION 2-134, AND 2-138
OF THE CODE OF ORDINANCES, AND REDUCING THE NUMBER OF PLANNING
BOARD MEMBERS FROM TWELVE TO NINE.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS,
TEXAS, THAT:
SECTION 1. Section 2-133 of the Code of Ordinances is hereby amended to
read as follows:
"Sec. 2-133. Created.
There is hereby created a planning board for the City composed of nine
(9) members, each of whom shall be a resident taxpaying citizen of the City, and
who shall serve without pay."
SECTION 2. Section 2-134 of the Code of Ordinances is hereby amended to
read as follows:
"Sec. 2-134. Appointment, term, chairman, vice chairman, and Board of
Aldermen representative.
The Mayor shall appoint members of the planning board and each person so
appointed must be approved by the Board of Aldermen before becoming a member thereof.
The terms of such members shall be for a period of three years; however, the terms
shall be so staggered that one-third (1/3) of the Board shall be appointed each year.
In 1976, one (1) member shall be appointed for a two (2) year term and one (1) member
shall be appointed for a three (3) year term; in 1977, three (3) members shall be
appointed for three (3) year terms and two (2) members shall be appointed for two
(2) year terms; thereafter, all members shall be appointed for three (3) year terms.
The Mayor with the approval of the Board of Aldermen shall nominate one of the
members as chairman, and the chairman shall appoint a vice chairman, both of which
will serve not more than two consecutive one (1) year terms in their respective
offices. The length of service by any member of the planning board shall be not
more than six (6) consecutive years; however, a member may be reappointed to the board
after an absence of three (3) years. The Mayor shall also appoint a member of the
Board of Aldermen to serve as a representative to the planning board. The repre-
sentative should attend all official planning board meetings and work sessions, but
shall be ex officio and non-voting. The term of office of each member shall commence
upon the approval of appointment by the Board of Aldermen, and shall terminate
whenever the member's replacement has been appointed and approved by the Board of
Aldermen. "

SECTION 3. Paragraphs (1) , (2) , (5) and (8) of Section 2-138 of the
Code of Ordinances are hereby amended to read as follows:
"(1) To make studies and project plans for the improvement of the city,
with a view for future development and extension and to recommend to the board of
aldermen all matters for the development and advancement of the city's facilities
and, particularly shall pass upon the application for plats requested for approval."
"(2) To make plans and maps of the whole or any part or portion of the
city and of land outside the city located within three and one-half (311) miles of
the city limits and any other land outside the city which, in the opinion of the
planning board, bears a relation to the planning of the city and to make changes in,
additions to, and extensions of such plans or maps when it deems the same advisable."
"(5) To act with and assist all other municipal and governmental agencies
and particularly the board of aldermen in formulating and executing proper plans of
municipal development and growth including annexation and disannexation."
"(8) To investigate, consider, and report to the board of aldermen upon
the lay-out or platting of any new subdivision of the city or of property situated
within three and one-half (31) miles of the city limits, as provided by the Municipal
Annexation Act (Article 970a of the Revised Civil Statutes of Texas) , and to recommend
the approval of all plans, plats, or re-plats of additions within the city limits or
within three and one-half (31) miles of the same, or of the rejection of either."
SECTION 4. Paragraph (11) of Section 2-138 is hereby deleted.
