ORDINANCE AMENDING SECTIONS 32-70, 32-72 AN1 32-79
OF THE CODE OF ORDINANCES, TO INCREASE THE PRO
RATA CHARGE FOR EXTENSIONS OF WATER MAINS AND
SANITARY SEWER MAINS IN THE CITY.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Section 32-70 of the Code of Ordinances
is hereby amended so that the pro rata charges set out
therein shall read as follows:
" (1) Two dollars and eighty cents ($2. 80) per
front foot of the lot or tract of land to which water
connections may be made.
(2) Two dollars and fifty cents ($2 . 50) per
front foot of the lot or tract of land to which sani-
tary sewer connections may be made. "
SECTION 2. The first sentence in the fourth para-
graph of Section 32-72 of the Code of Ordinances is
hereby amended to read as follows:
"Two dollars and eighty cents ($2 .80) per front
foot for water extensions, and two dollars and fifty
cents ($2. 50) per front foot for sewer extensions on
all property served by the desired main extension,
less the one hundred (100) feet allowable, and the
City of Wichita Falls, when said money has been actu-
ally deposited with the City of Wichita Falls, will
construct the said desired water or sewer main along
a street, alley or easement. "
SECTION 3. Section 32-79 of the Code of Ordinances
is hereby amended to read as follows:
"In no event shall the City be obligated to proceed
under the terms of this article if funds are not avail-
able or if in the discretion of the City the extension
may not be practical.
All property platted into lots or tracts and having
existing water and sanitary sewer mains installed by the
City on December 1, 1959, shall be exempt from the pro
rata charges for the water and sanitary sewer mains as
to the said existing adequate mains. Where such pro-
perty is later subdivided, whereby an extension of
mains is required to serve same, then the terms of this
article shall govern.
On all mains which are constructed or under con-
tract for construction between December 1st, 1959 and
January 1st, 1977, the pro rata charge for connecting
properties thereto prior to October 1st, 1977 shall be
at the old rate of $1. 90 per front foot for water and
$1. 60 per front foot for sewer; the pro rata charge
for connecting properties thereto after October 1st,
1977 shall be at the rates contained in this ordinance.
On all mains which are under contract and constructed
after January 1st, 1977, the pro rata charge for connect-
ing properties thereto shall be at the rate contained
in this ordinance.
Where the property owner or developer has already
paid or contributed towards any of the existing lines,
then the property properly served by the existing mains
without extension thereof shall be exempt from the pro
rata charges for water or sewer connections. "
SECTION 4. The pro rata charges established herein
shall not change the pro rata charge for sewer mains
in Vista Heights, Holliday Gardens and other nearby
areas established by the Board of Aldermen in Ordinance
No. 2300, nor change the pro rata charge for sewer
mains in Rancho Vista and Seymour Heights Additions
as heretofore established by the Board of Aldermen.
