AN ORDINANCE AMENDING SECTION 29-91.1 OF THE CODE
OF ORDINANCES OF THE CITY OF WICHITA FALLS, TEXAS;
ESTABLISHING REDUCED PRIMA FACIE MAXIMUM SPEED
LIMITS FOR CERTAIN HAZARDOUS CONDITIONS IN CERTAIN
ZONES; PROVIDING FOR THE REGULATION OF SPEED BY
SPEED LIMIT SIGNS EQUIPPED WITH FLASHING YELLOW
LIGHTS; AND, DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
SECTION 1. Section 29-91 of the Code of Ordinances of the City of Wichita Falls
is hereby amended to read as follows:
"Sec. 29-91.1. Maximum speed limits in certain zones.
(a) It is hereby deemed upon the basis of an engineering survey and traffic
investigation that the speed permitted by State law and/or City ordinance upon certain
streets is greater than is necessary for the safe operation of vehicles thereon during
certain times of the day due to the particular hazards existing during those times. It
is hereby declared that the prima facie speed limits are altered on those streets set
out in the schedule in this section during those hours of the day when signs are erected
by public authority giving notice thereof.
"(A) Avenue K
(1) 20 MPH From Arthur Street to Hayes Street.
(B) Midwestern Parkway
(1) 20 MPH From Manor to Southmoor Lane.
(C) Missile Road From a point 500 feet east of Hooper
(1) 20 MPH Drive to a point 500 feet west of Hooper Drive.
(D) Grant Street
(1) 20 MPH From Avenue N to Avenue Q.
(E) York Street From a point 150 feet west of Hayes Street
(1) 20 MPH to Grant Street,

(b) The City Traffic Engineer is hereby authorized to erect signs for the purpose
of giving notice of the reduced prima fade speed limits set out in (a) above. The authorized
sign may utilize flashing yellow lights and may contain a legend which notifies drivers that
the reduced prima facie speed limit is in effect when the yellow lights are flashing. The
City Traffic Engineer shall have authority to regulate and adjust the times when the yellow
lights are in operation on the authorized sign. At all times other than those when the
yellow lights are flashing on the authorized sign, the prima facie speed limits at the loca-
tions listed in (a) above shall revert to the prima facie limits previously established by
State Law and/or ordinance.
(c) Any speed in excess of the limits specified in this section when the flashing
yellow lights are in operation on the authorized sign shall be prima facia evidence that the
speed is not reasonable or prudent and that it is unlawful."
SECTION 2. The fact that the prima facie speed limits set out in this ordinance
are necessary to the safe and orderly movement of traffic upon the streets of the City of
Wichita Falls and because it is deemed necessary to regulate the speed of vehicles through
the use of signs which give notice to drivers of reduced prima facie speed limits by utilizing
flashing yellow lights, this ordinance is declared to be an emergency measure on the ground
that there is an urgent public need for the orderly flow of traffic upon the streets and a
public need for the preservation of the peace, health and safety of the lives and property of
the citizens of the City. This ordinance will particularly aid in protecting the lives and
safety of children crossing the streets near our public schools. This ordinance shall,
therefore, take effect immediately upon its passa/geeD..��
