AN ORDINANCE AMENDING SECTION 29-172 OF THE CODE
OF ORDINANCES OF THE CITY OF WICHITA FALLS, TEXAS
PROVIDING THAT NO PERSON SHALL SOLICIT A RIDE, CON-
TRIBUTIONS, EMPLOYMENT OR BUSINESS FROM THE OCCU-
PANT OF ANY VEHICLE, WHILE STANDING IN THE ROADWAY,
ON,A MEDIAN, ON THE CURB, ON THE SHOULDER, OR ON .
THE PUBLIC SIDEWALK ADJACENT THERETO, OF ANY PUBLIC
STREET.
WHEREAS, it is recognized that a person standing on or in the roadway,
on a median,on the shoulder, or on a public sidewalk adjacent to any public street
• and soliciting the occupants of motor vehicles constitutes a hazard in that this person
interferes with the free movement of motor vehicle traffic on the roadway and may
distract the attention of drivers of motor vehicles; and,
WHEREAS, soliciting of rides, employment, business, or contributions can
be better and more safely accomplished in locations which are not on or immediately
adjacent to public streets; and,
WHEREAS, the City in the exercise of its police powers may regulate the
use of the public streets and sidewalks adjacent thereto and may prohibit those uses
which constitute an interference with the free flow of traffic and the safe and unimpeded
use of these thoroughfares.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF
THE CITY OF WICHITA FALLS, TEXAS, THAT:
Sec. 29-172 of the Code of Ordinances of the City of Wichita Falls, Texas,
is hereby amended to read as follows:
"Sec. 29-172. Soliciting rides, business, employment or contributions.
(a) No person shall stand in a roadway, on a median, on the curb adjacent
to a roadway, on the shoulder of a. roadway, or on any public sidewalk immediately
adjacent to a roadway, for the purpose of soliciting a. ride, contributions, employment
or business from the occupants of any vehicle; provided, that in an emergency a. person
may stand on the median, on the shoulder adjacent to a roadway, on a curb adjacent to
a roadway, or on a public sidewalk adjacent to a roadway and solicit aid from the
occupants of other vehicles.
(b) No person shall stand on or in the proximity to a street or highway for
the purpose of soliciting, the watching or guarding of any vehicle while parked or about
to be parked on a street or highway."
