Ord 3149 12/21/1976 ORDINANCE NO. 0 AN ORDINANCE EXTENDING THE CITY LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, BY ANNEXING CERTAIN LANDS ADJACENT TO THE TERRI- TORIAL LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, WHICH LANDS ARE DESCRIBED IN THIS ORDINANCE. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: SECTION 1. That the following tract of land located in Wichita County, Texas, be and the same is hereby ordered to he annexed and to be included within the corporate limits of the City of Wichita Falls, Texas, and the corporate limits be extended so as to include said tracts of land in Wichita County, Texas, the same being more particularly described as follows: Being a tract of land located in Denton County School Lands, League 2, A-57, Wichita County, Texas, more fully described as follows: Tract I Beginning at the intersection of the northwest right-of-way line of the Fort Worth & Denver Railroad with the north right-of-way line of FM Hwy 369 as described in the plat of the Certain-Teed Product Addition, Tract I as recorded in Volume 22, pages 21 and 22 of the Wichita County Plats records; Thence north 89° 29' 19" west 543.27 feet along the north right-of-way line of FM 369 to the point of beginning of this Tract, said point being the southeast corner of a 0.5 acre tract sold to Swaden & Carlton and described in a deed recorded in Volume 1054, page 648, Deed Records of Wichita County, Texas; . Thence north 000 28' 48" west 777.02 feet to a corner; Thence north 89° 14' 09" west 638 feet more or less to the west right- of-way line of Allendale Road as described in Ordinance 1910, said point being in the present city limits line; Thence south along the west right-of-way line of Allendale Road and Allendale Road produced, being the present city limits line as described in said Ordinance 1910, to the south right-of--way line of FM 369; Thence easterly along the south right-of-way line of said FM 369 to a point 120 feet south of the beginning point of this tract; Thence north 120 feet to the point of beginning and containing 13.2 acres of land more or less. SECTION 2. In conformity with Section 6 of Article 970a of the Revised Civil Statutes of Texas, before the annexation proceedings were instituted, the Board of Aldermen called a public hearing on November 4, 1976 to provide an oppor- tunity for all interested persons to he heard; notice of such hearing was published once in the Wichita Falls Record News not more than twenty (20) days nor less than ten (10) days prior to the public hearing. Such public hearing was held on November 23, 1976, which was not more than twenty (20) days nor less than ten (10) days prior to the institution of the annexation proceedings. SECTION 3. In conformity with Section 3-A of the amended Charter of the City of Wichita Falls, Texas, this ordinance is on the 7th day of December, 1976 introduced, and the City Clerk is directed to publish said ordinance one (1) time in a newspaper of general circulation published in the City of Wichita Falls, Texas, and seven (7) days thereafter this ordinance may be finally acted upon. SECTION 4. The fact that this is an urbanizing area, and City safety, health and police controls and measures will be needed, creates an emergency, and it is hereby declared that this ordinance is an emergency measure on the grounds of public need for the preservation of the peace, health, and safety of property of the city, and this ordinance shall go into effect immediately upon its passage. This ordinance having been introduced on the 7th day of December, 1976 and having been published in a newspaper of general circulation in the City of Wichita Falls, Texas. to wit, the Wichita Falls Record News, one (1) time, on the 11th day of December, 1976 and seven (7) days after such publication having elapsed, this ordinance is finally passed and approved this the 21st day of December, 1976.
