AN ORDINANCE CORRECTING THE MISTAKE IN ORDINANCE
NO. 3069 OF LETTERING PARAGRAPH (AO) ; ADDING PAR-
AGRAPH (AS) TO SECTION 29-91 OF THE CODE OF OR-
DINANCES OF THE CITY OF WICHITA FALLS , TEXAS , ES-
TABLISHING A PRIMA FACIA MAXIMUM SPEED LIMIT ON A
PORTION OF HAMILTON BOULEVARD; AND DECLARING AN
EMERGENCY.
WHEREAS , on March 16 , 1976, the Board of Aldermen passed
Ordinance No. 3069 which in Section 2 thereof added Paragraph
(AO) which set a prima facia maximum speed limit of 35 miles
per hour on Maplewood Avenue from Southwest Parkway (FM 369)
to Kemp Boulevard; and,
WHEREAS , previously on February 17 , 1976, the Board of
Aldermen passed Ordinance No. 3060 which had added Paragraph
(AO) among others, which said Paragraph (AO) set certain
maximum prima facia speed limits on Loop 11; and,
WHEREAS , by mistake, the Paragraph establishing the
prima facia maximum speed limit on Maplewood Avenue was
designated as Paragraph (AO) when it should have been pro-
perly designated as Paragraph (AR) ; and,
WHEREAS , it was not the intention of the Board of Al-
dermen in passing Ordinance No. 3069 to repeal Ordinance No.
3060 insofar as Paragraph (AO) was properly meant to set
certain prima facia maximum speed limits on Loop 11; and,
WHEREAS , in order to correct this mistake Paragraph (AO)
in Ordinance No. 3069 should be changed to read Paragraph
(AR) ; and
WHEREAS , after an engineering study and survey, it has
been determined that there is a need for a different prima
facia maximum speed limit on a portion of Hamilton Boulevard.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN
OF THE CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Ordinance No. 3069 of the City of Wichita
Falls, Texas, is hereby amended by changing all references
contained therein to Paragraph (AO) to read "Paragraph (AR) . "
SECTION 2 . Section 29-91 of the Code of Ordinances
of the City of Wichita Falls is hereby amended by adding
Paragraph (AS) which shall read as follows:
" (AS) Hamilton Boulevard
(1) 40 MPH From Speedway Avenue to Hampstead
Lane. "
SECTION 3. The fact that the prima facia speed limit
set out in this ordinance is necessary to the safe and or-
derly movement of traffic upon the streets of the City of
Wichita Falls, this ordinance is declared to be an emergency
measure on the ground that there is an urgent public need
for the orderly flow of traffic upon the streets, and a
public need for the preservation of the peace, health, and
safety of the lives and property of the citizens of the City.

This ordinance shall, therefore, take effect immediately
upon its passage.
