ORDINANCE GRANTING WAIVER OF SECTION 8-2 AND
27-5 OF THE CODE OF ORDINANCE ON JULY 16, 1977
FOR ANNUAL SIDEWALK SALE IN THE CENTRAL BUS-
INESS DISTRICT.
WHEREAS, The Downtown Association has requested permission to hold
its annual sidewalk sale on July 16, 1977 in the Central Business District; and,
WHEREAS, Section 8-2 of the Code of Ordinances controls the advertising
and selling of goods on public right-of-way, and Section 27-5 restricts the storage
of equipment and goods on streets and sidewalks.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN
OF THE CITY OF WICHITA FALLS, TEXAS, THAT:
The provisions of said Section 8-2 and Section 27-5 of the Code of Ord-
inances is hereby waived for the purpose of allowing the annual sidewalk sale on
July 16, 1977 in the Central Business District; provided, however, that each
merchant who participates in the sale. shall take every precaution to make sure
that the sidewalk in front of his store is safe for pedestrians, and he shall not
allow his merchandise to be placed on the sidewalk in such a manner that it
constitutes a hazard; further, each merchant participating in such sale shall
indemnify the City from all liability for damages arising out of the use of the
sidewalk for the display and sale of merchandise.
