ORDINANCE ALLOWING THE EXTENSION OF ORDINANCE
NO. 2138 FOR A PERIOD OF FOUR YEARS AFTER
SEPTEMBER 30, 1977 , AMENDING SECTION 10 OF
ORDINANCE NO. 2138 CONCERNING ANNUAL CASH
CONSIDERATION TO BE PAID BY THE TELEPHONE
COMPANY, AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The request of Southwestern Bell Telephone
Company that Ordinance No. 2138 be renewed is hereby allowed
to the extent of a four year period; Ordinance No. 2138
is hereby renewed for a period of four years after September
30, 1977.
SECTION 2. Section 10 of Ordinance No. 2138 is hereby
amended to read as follows:
"SECTION 10 - ANNUAL CASH CONSIDERATION TO BE PAID BY THE TELE-
PHONE COMPANY
To indemnify the City for any and all possible damages to its
streets, alleys and public grounds which may result from the
placing and maintenance therein or thereon of the Telephone
Company' s poles, conduits, or other telephone equipment or appar-
atus, and to compensate the City for its superintendence of this
agreement, and as the cash consideration for the same, the
Telephone Company agrees to pay to the City annually during
the continuance of the agreement a sum of money equal to three
percent (3%) of the annual gross receipts for the preceding year
received by the Company from the rendition of local exchange
telephone transmission service within the corporate limits of
the City. The first payment hereunder shall be made March 15,
1978 and shall equal in amount three percent (3%) of the gross
receipts received from January 1, 1977 to December 31, 1977;
and thereafter payment shall be made annually on March 15 as
herein provided. "
SECTION 3. The fact that continuation of telephone ser-
vices necessary for the preservation of the peace, health and
safety of property of the City creates an emergency, and this
ordinance is declared an emergency measure, and shall become
effective upon its adoption. -
