ORDINANCE GRANTING AUTHORITY TO THE FIRST-WICHITA
NATIONAL BANK TO CONSTRUCT AN UNDERGROUND TRANS-
FORMER VAULT IN BLOCK 164 OF THE ORIGINAL TOWN OF
WICHITA FALLS.
WHEREAS, The First-Wichita National Bank is constructing a
new office building on a portion of the east one-half of Block 164 of the
original town of Wichita Falls, and it has requested authority from the
Board of Aldermen to construct an underground transformer vault below
the alley surface in the alley of the block bounded by Scott and Indiana,
and Seventh and Eighth Streets.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF
THE CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1 . The First-Wichita National Bank is hereby granted
the right and authority to construct an underground transformer vault in the
alley in Block 164 of the Original Town of Wichita Falls. The size of the
transformer vault will be a ten foot by twelve foot access with a grate over
the opening to handle heavy vehicle loads.
SECTION 2. Said bank shall coordinate such construction with
all utility companies whose facilities are located in the alley.
SECTION 3. It shall be the responsibility of the bank at all
times to maintain said transformer vault at its own expense. If at any time
in the future some public use of such alley makes it necessary that the
transformer vault be relocated or removed, such relocation or removal shall
be done at the sole cost and expense of the bank.
SECTION 4. Whenever any work is being done on the transformer
vault, the bank shall take all necessary and proper precautions to protect the
public from damages. The bank shall hold and save the City of Wichita Falls
harmless from all damages or claims for damages resulting from the construction,
maintenance and location of such transformer vault.
SECTION 5. The right and authority hereby granted is for so
long as said transformer vault is used and maintained by said bank. When the
transformer vault is no longer so used, it shall be removed by the bank at
its sole cost and expense.
