ORDINANCE NO. 3 2/
AN ORDINANCE DECLARING CERTAIN TERRITORY
EXISTING WITHIN THE CORPORATE LIMITS OF
THE CITY OF WICHITA FALLS AS NOT SUITABLE
OR NECESSARY FOR CITY PURPOSES; DESIGNATING
SUCH TERRITORY AND DISCONTINUING THE SAME
FROM AND ELIMINATING THE SAME AS A PART
OF THE CITY OF WICHITA FALLS; PROVIDING THAT
SUCH ORDINANCE SHALL NOT AFFECT THE RIGHT
AND POWER OF THE CITY OF WICHITA FALLS TO
PROTECT ITS WATER SUPPLY; PROVIDING FOR A
REPEALER; PROVIDING FOR SEVERABILITY AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS , TEXAS , THAT:
SECTION 1. The territory described on Exhibit A attached
hereto and made a part hereof for all purposes (hereinafter
referred to as "the territory" ) is within the corporate
limits of the City of Wichita Falls.
SECTION 2. The territory is not suitable or necessary
for city purposes.
SECTION 3. The territory is inhabited.
SECTION 4. A petition signed by a majority of the
qualified voters residing in such territory, describing the
territory and requesting that it be discontinued as a part
of the City of Wichita Falls has been presented to the Board
of Aldermen.
SECTION 5. The petition is in due form as required by
law and the Charter of the City of Wichita Falls.
SECTION 6. The petition specifically and accurately
describes the territory and contains a plat designating the
same.
SECTION 7. The territory should be and is hereby dis-
continued as a part of the City of Wichita Falls and is
eliminated from said city.
SECTION 8. Nothing herein shall be construed to limit
or restrict the right and duty of the City of Wichita Falls
to regulate and protect its water supply.

SECTION 9. That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed to
the extent of such conflict.
SECTION 10. If for any reason any section, paragraph,
subdivision, clause, phrase, word or provision of this ordin-
ance shall be held invalid or unconstitutional by final
judgment of a court of competent jurisdiction it shall not
affect any other section, paragraph, subdivision, clause,
phrase, word or provision of this ordinance, for it is the
definite intent of this Board of Aldermen that every section,
paragraph, subdivision, clause, phrase, word or provision
hereof be given full force and effect for its purpose.
SECTION 11. The fact that there is an imperative need
to discontinue the territory from and eliminate it as a part
of the City of Wichita Falls before January 1, 1978, so as
to avoid taxation of property within that territory for the
year 1978 and to eliminate the necessity of assessing and
collecting taxes thereon and to eliminate the expenses thereof
creates an emergency and necessity that this ordinance take
effect and be in full force and effect from and after its pas-
sage.
SECTION 12. This ordinance is passed and approved by a
vote of 2/3 of all of the aldermen of the City and shall take
effect and be in full force and effect from and after its
passage.
PASSED AND APPROVED this the 20th day of December, 1977.
