Ord 3279 1/3/1978 e 4 ORDINANCE NO. ,;U;,11 ORDINANCE AMENDING SEC. 29-259 (b) (1) PROVIDING THAT THE MINIMUM CAPACITY OF A WRECKER TO BE CERTIFIED SHALL BE NOT LESS THAN TWO (2) TONS; AND PROVIDING FOR AN EMERGENCY. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Sec. 29-259 (b) (1) of the Code of Ordinances is hereby amended to read as follows: " (1) Shall not be less than two (2) tons in capacity, as reflected on the manufacturer' s certificate. If the unit does not have a manufacturer' s certificate, then the minimum capacity of the wrecker shall be determined by a testing procedure approved by the Chief of Police; " SECTION 2. Whereas, there exists an urgent necessity to keep the wrecker rotation certification procedure operating without undue delay, so that wrecked and disabled vehicles may be safely and expeditiously removed from the streets and highways of the City, thereby protecting the health, safety and welfare of our citizens, this ordinance is deemed to be an emergency measure and shall take effect immediately upon its passage.
