ORDINANCE PROHIBITING POSSESSION OF LIGHTED
TOBACCO PRODUCTS AND SMOKING OF TOBACCO IN
CERTAIN PUBLIC MEETINGS IN THE CITY.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
WICHITA FALLS , TEXAS, THAT:
SECTION 1. It shall be unlawful for any person to be
in possession of a burning tobacco product or to smoke tobacco
in any public meeting held in any building owned by the
City of Wichita Falls. A public meeting, for the purposes
of this ordinance, shall be any meeting for which a public
notice is posted by the City Clerk as required by the Open
Meetings Law. It shall be a defense to prosecution under
this ordinance that the meeting room in which the offense
takes place does not have prominently displayed a reasonably
sized notice that smoking is prohibited.
SECTION 2. Any person convicted of a violation of
this ordinance may be punished by a fine not to exceed $200.
