AN ORDINANCE TO PROVIDE FOR PERMIT FEES FOR FROZEN DESSERT
PROCESSORS, DISTRIBUTORS, OUT-OF-CITY ICE CREAM, ICE CREAM
MIX AND/OR MOBILE UNIT, FOUNTAIN AND COUNTER FREEZERS
SELLING PRODUCTS INTO WICHITA FALLS; PROVIDING FEES FOR SUCH
PERMITS; PROVIDING FOR AN EMERGENCY.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS,
TEXAS, THAT:
SECTION 1. The following fees shall be charged for permits required for
persons, firms or corporations engaged in ice cream, soft serve and frozen
dessert industry:
A. All ice cream and/or frozen desserts processing plants in Wichita
Falls, Texas which are regularly inspected by a milk sanitarian of the milk
division of the City-County Health Center shall be required to secure a permit
on January 1st of each year from the milk division for a fee of $3,000.00,
which may be prorated per month in twelve equal installments of $250.00 each.
B. All ice cream and/or frozen desserts processing plants which are
not regularly inspected by a milk sanitarian of the milk division shall be
required to secure a permit on January 1st for a fee of $250.00.
C. All soft serve frozen desserts establishments shall be required to
secure a permit from the milk division on January 1st of each year at the rate
of $35.00 per year or any part thereof.
D. All frozen desserts distributors shall be required to secure a
permit from the milk division on January 1st of each year at the rate of $35.00
per year or any part thereof.
E. All frozen desserts mobile units and commissary depots shall be
required to secure a permit from the milk division on January 1st of each year
at the rate of $20.00 per year or any part thereof.
F. All fountain and/or counter freezer processing frozen desserts
shall be required to secure a permit from the milk division on January 1st of
each year at the rate of $35.00 per year or any part thereof.
G. All other types of freezers which may be used to process or manu-
facture ice cream, ice cream mix, frozen desserts or frozen dessert mix having
a hard or soft consistency, shall be required to secure a permit the same as
under subsection (F) above.
H. All out-of-city ice cream, ice cream mix and/or frozen dessert
processors shall be required to secure a permit on January 1, 1978 for the
year 1978, from the milk division of the City-County Health Unit for a fee of
$250.00
SECTION 2. Subsection (H) of Section 16-64 of the Code of Ordinances,
as amended by Ordinance #3269, is hereby repealed.
SECTION 3. The fact that the manufacture, distribution and sale of ice
cream, soft serve and frozen desserts are not now regulated in the City of
Wichita Falls, creates a health hazard, and this ordinance is declared to be
an emergency measure which shall go into effect immediately upon its passage.
