Ord 3299 3/21/1978 ORDINANCE NO. 2,,;W ORDINANCE REPEALING ORDINANCE NO. 3268 AND SECTION 2 OF ORDINANCE NO. 3267 , AND ALLOWING THE EXTENSION OF ORDINANCE NO. 2138 FOR A PERIOD ENDING AUGUST 1, 1978. WHEREAS , prior to September 6, 1977 , Southwestern Bell Telephone Company requested that Ordinance No. 2138 be renewed for a four year period; and, WHEREAS, Section 2 of Ordinance 3267 , adopted on December 6, 1977 refused the request of Southwestern Bell Telephone Company to renew Ordinance No. 2138; and, WHEREAS, by Ordinance No. 3268 , adopted January 3rd, 1978 , the Board of Aldermen authorized Southwestern Bell Telephone Company to erect and maintain its poles, wires and other facilities along and across all public streets, alleys and other public places in the City, and provided that the City shall receive from the company an annual payment equal to three percent of the annual gross receipts received by the company from rendition of local exchange telephone transmission service within the corporate limits; and, WHEREAS, the Telephone Company declined to accept Ordinance No. 3268, and the City and the Telephone Company are presently attempting to resolve their differences, and both parties desire that the Telephone Company continue to operate for a limited period of time under the old agreement. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Ordinance No. 3268 is hereby repealed, and Section 2 of Ordinance No. 3267 is hereby repealed. SECTION 2. The request of Southwestern Bell Telephone Company that Ordinance No. 2138 be renewed is hereby allowed for a period ending August 1, 1978; Ordinance No. 2138 , with the expanded tax base on gross receipts tax payment to include revenue collected from customers for advertising in the Wichita Falls telephone directory whose businesses are located in the City limits and revenue collected from custo- mers for moves and change charges completed within the City limits of Wichita Falls, is hereby renewed for a period ending August 1, 1978. SECTION 3. The fact that continuation of telephone service is necessary for the preservation of the peace, health and safety of property of the City creates an emergency, and this ordinance is declared an emergency measure, and shall become effective upon its adoption.
