RESOLUTION ACCEPTING CONSTRUCTION AND AUTHORIZING
FINAL PAYMENT TO TIMMINS-ANDERSON CORPORATION ON
THE 1980 COMMUNITY DEVELOPMENT ASSESSMENT PAVING
PROGRAM IV.
WHEREAS, the City of Wichita Falls and Timmins-Anderson
Corporation entered into a contract dated May 6, 1980 , whereby
said contractor agreed to construct the 3980 Community Development
Assessment Paving Program IV; and,
WHEREAS , heretofore the contractor completed the street
assessment paving portion of this contract , and that portion was
accepted under Ordinance No. 3767; and,
WHEREAS, all of this project has now been completed in
accordance with the plans and specifications; and,
WHEREAS, Change Order No. 1 has heretofore been approved; and,
WHEREAS, the final estimate has been submitted, which shows
the total amount due under such contract is $1, 161 , 059 . 61 , of which
1, 159 , 359 . 61 has been paid to the contractor , leaving a balance due
of $1,700. 00.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF
THE CITY OF WICHITA FALLS, TEXAS, THAT :
The construction of such project is hereby accepted , the final
estimate is hereby approved, and the City Manager is authorized to
pay to said contractor the balance due as set out above.
