Res 110-82 7/6/1982RESOLUTION NO. ///d-D' RESOLUTION APPROVING AND AUTHORIZING CITY MANAGER TO EXECUTE CONTRACT WITH JOHN A. ERICKSON FOR AR- CHITECTURAL INSPECTION SERVICES WITH REFERENCE TO THE CONSTRUCTION OF THE SOLID WASTE TRANSFER STATION. BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS , TEXAS, THAT : That certain contract, a copy of which is attached hereto , be- tween the City of Wichita Falls and John A. Erickson for the perform- ance of architectural inspection services with reference to the con- struction of the solid waste transfer station, is hereby approved, and the City Manager is authorized to execute the same for the City of Wichita Falls. Erickson, hereinafter called Architect, SITNESSETH: WHEREAS, City is having constructed a solid waste transfer station on a tract n: land located on Lawrence Road in the City of Wichita Falls, and they desire to contract with Architect for the furnishinc of architectural inspection services with reference to the construction of such transfer station. NOW, THEREFORE, for and in consideration of the mutual covenants hereinafter set forth to be kept and performed by the parties hereto, City and Architect hereby agree as follows: 1. Architect acrees to perform the architectural inspection ser- vices for such solid waste transfer station as hereinafter set out. 2. City agrees to pay Architect as compensation for his ser- vices as follows: A. Fee of $18.50 per hour for Architect's time devoted to this project in inspection and preparing reports; however, the total of such fee payable under this contract shall not exceed $12,000. B. Reimbursement of direct expenses actually spent by Ar- chitect on this project for copying costs, toll telephone calls and transportation; transportation shall be charged at the rate of 20 cents per mile. 3. The professional inspection services to be performed by Architect shall be comprised of the following: he shall make periodic inspections of the construction as it progresses to determine if the work is being done generally in compliance with the plans and speci- fications; although such inspections shall not ba continuous, they shall be of sufficient frequency and duration as are necessary reason- ably to determine that such work is being done in compliance with the plans and specifications. Architect shall advise with City as to the amounts of periodic payments due to the general contractor. If re- quested by City, Architect shall assist City in making the final inspection of the completed project. rr=:,•f?.:tti Vic';..s'+ra+c+v, Page of Pages Agenda Item No. 4. At the end of each month, City will pay Architect on the basis of his bill for professional services performed and direct expenses spent. 5. Either party ;,.ay terminate this agreement by giving the other arty at least two weeks notice in writing of such termination. Upon such termination, City shall pay Architect for the professional ser- vices he performed to the date of termination, and for the direct expenses he spent to such date.
