ORDINANCE ACCEPTING IMPROVEMENTS OF A PORTION OF
BARNETT ROAD FROM F. M. HIGHWAY NO. 369 (SOUTH-
WEST PARKWAY) TO 2736 FEET SOUTH IN THE CITY OF
WICHITA FALLS, TEXAS AS DESIGNATED IN ORDINANCE
NO. 4006 DECLARING THE CONTRACT WITH THE TEXAS
STATE HIGHWAY DEPARTMENT, FOR THE CONSTRUCTION
OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORM-
ED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY
OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS
LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HERE-
IN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID
ASSESSMENTS ; DIRECTING THE CITY CLERK TO ENGROSS
AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION
OF SAME IN THE MINUTE BOOK OF THE BOARD OF ALDER-
MEN OF THE CITY OF WICHITA FALLS , TEXAS , AND BY
FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORD-
INANCE RECORDS OF SAID CITY ; AND PROVIDING AN EF-
FECTIVE DATE.
WHEREAS , the City of Wichita Falls , Texas has heretofore entered into
contract with the Texas State Highway Department for the making and constructing
of certain street improvements on the hereinafter described portions of streets ,
avenues and public places in the City to-wit:
A portion of Barnett Road from the South property
line of F.M. Highway No. 369 (Southwest Parkway)
to South 2,736 feet.
WHEREAS , by sundry proceedings heretofore passed by the Board of Alder-
men of the City of Wichita Falls , Texas , including Ordinance No. 3202 a portion
of the cost of said improvements was levied and assessed against the respective
properties abutting on each of the above assessed portions of streets , avenues ,
and public places and against the real and true owners thereof; and,
WHEREAS, the Board of Aldermen of the City of Wichita Falls , Texas has
upon review, found and determined that, in some instances , in order to effect
substantial justice and equality, it is desirable and necessary to grant and
issue certain credits against some one or more of the assessments levied by Ord-
; inance No. 3202; and,
WHEREAS, the street improvements hereinabove mentioned have been comp-
leted upon each of the portions of streets , avenues and public places hereinabove
described, and have been inspected and found to be in complete accordance with the
contract therefor;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
WICHITA FALLS, TEXAS , THAT:
The improvements on each of the portions of streets , avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract
with reference thereto be, and is hereby, found and declared fully completed and
performed.
II .
The assessments are levied by Ordinance 3202 shall be computed for
each property owner and the same together with the Engineer's Roll of a portion
of Barnett Road from the South property line of F.M. Highway No. 369 (Southwest
Parkway) to south 2,736 feet project herein accepted shall be delivered '
to the Tax Assessor-Collector, and he shall prepare statements which shall be
sent to the property owners .

The City Clerk is hereby directed to engross and enroll this Ordinance
by copying the caption of same in the Minute Book of the Board of Aldermen of the
City of Wichita Falls , Texas , and by filing the complete Ordinance in the appro-
priate Ordinance Records of said City.
IV.
This Ordinance shall take effect and be in full force and effect from
and after the date of its passage.
